社会学视野下中华司法人文传统的形成、发展与传承

【摘要】：中国传统社会司法运行中,情理法融合形成了显明的人文精神特征和对法文化追求的人文传统。本文以社会学为视角研究这一法律现象,深入整理、归纳影响中华司法人文传统的内涵特质及形成、演进的社会性因素,系统分析其与社会思想文化、社会结构、社会秩序之动态关联,为中华司法人文传统与社会发展之间的互动联系提供一种社会学的解释,以期探求传统司法在近现代社会变迁与互动发展的演进脉络及蕴含规律。
[Abstract]:In the judicial operation of Chinese traditional society, the integration of love and reason forms the distinctive humanistic spirit and the humanistic tradition pursued by the law culture. This paper studies the phenomenon of law perspective in sociology, further classified social factors and the formation and characteristics of the Chinese traditional cultural connotation of judicial evolution, system analysis and the dynamic relationship between social ideology, social structure, social order, provides a sociological explanation for the relation between the Chinese company law the traditional humanities and social development, to explore the traditional judicial and law contains in the evolution and the transformation of modern society development.
