转型期的道德重建与法治秩序建构

【摘要】：一个事物的发展往往包括几个发展阶段,而上一个发展阶段与下一个发展阶段之间必然会存在着很多的差异,从而也就会产生许多的矛盾。怎么能使得一个事物从一个阶段向另一个阶段顺利地跨越,对于各阶段之间的过渡性节点的控制尤为重要,而道德控制和法律控制又是转型期社会控制的重要手段,所以转型期的道德建设与法治建构问题显得尤为紧迫。我国当前正处在这样的转型期,以往的计划经济体制已被抛弃,市场经济体制正在建成,由于经济基础决定上层建筑,所以各行各业的人们,无论是政治、经济,还是宗教、文化等,他们都面临着同样的焦虑——即自己的未来将何去何从?同样作为上层建筑的道德与法律也面临着类似的问题。道德和法律与人们的行为是分不开的,所以他们所面临的问题就显得更为复杂。在道德方面,我们已经抛弃了先前的道德观,对于新的道德观还没有形成,从而使得我们的道德信仰陷入危机。道德控制与法律控制同为社会控制的重要手段,他们之间是相辅相成的,道德信仰的危机也就会影响到法治秩序的建构。在本文当中,笔者从道德与法律的相互关系入手,逐步分析当前道德危机出现的原因及引发的问题,从而探讨道德体系的重建与法治秩序的建构之路。
[Abstract]:The development of a thing often includes several stages of development, and there are bound to be many differences between the last stage of development and the next stage of development. Thus, there will be a lot of contradictions. How to make a thing from one stage to the other stage of the smooth leap, for the control of transitional nodes between the stages is particularly important. Moral control and legal control are important means of social control in the transition period, so the construction of morality and the rule of law in the transition period is particularly urgent. The former planned economy system has been abandoned, the market economy system is being built, because the economic base determines the superstructure, so people in various industries, whether it is politics, economy, religion, culture, etc. They all face the same anxiety about where their future will go? Morality and law, which are also superstructures, face similar problems. Morality and law are inseparable from people's behavior, so the problems they face are more complex. We have abandoned the previous moral concept, for the new moral concept has not been formed, so that our moral beliefs into a crisis. Moral control and legal control are both important means of social control. They complement each other, and the crisis of moral belief will affect the construction of legal order. In this paper, the author starts with the relationship between morality and law. The causes and problems caused by the current moral crisis are analyzed step by step, so as to explore the reconstruction of moral system and the construction of the order of rule of law.
