【摘要】:不动产和人们的日常生活联系密切,而不动产登记制度是确保不动产交易安全的重要法律制度,所以研究不动产登记制度有很大的现实意义。物权法为我国不动产登记制度确立了基本原则和方向,但是大多数规定过于抽象,并不能很好的规范不动产交易行为,因此应该尽快制定统一的不动产登记法。相对于我国而言,日本的不动产登记法已经制定了100多年,经过不断的修改,已经形成了比较完善的不动产登记制度体系。故本文主要通过介绍和探讨日本不动产登记制度的发展和完善历程,进而提出完善我国不动产登记制度的建议。 本文主要分为四个部分:第一部分是日本不动产登记制度的历史沿革,由三节组成,第一节是明治维新以前的不动产公示制度;第二节是明治维新时期确定的不动产公示制度;第三节是不动产登记法的制定及其发展,通过这三节的介绍可以了解日本不动产登记制度的发展和完善过程。第二部分是日本现行的不动产登记制度,主要是对不动产登记制度的体系和特点、登记机关与登记簿、登记的分类以及登记程序作了介绍。第三部分是日本不动产登记的效力,重点分析了日本独特的背信恶意者排除理论和登记公信力的相对确认。第四部分是日本不动产登记制度对我国的启示,首先分析了我国不动产登记制度的现状及问题,然后通过借鉴日本经验提出了五点完善措施。
[Abstract]:Real estate and people's daily life is closely linked, and the real estate registration system is an important legal system to ensure the real estate transaction security, so it has great practical significance to study real estate registration system. The property law of China's real estate registration system to establish the basic principles and direction, but most of the provisions are too abstract that standard is not a good real estate transactions, real estate registration law should therefore be enacted as soon as possible. With respect to our country, not real estate registration law in Japan has developed more than 100 years, through continuous modification, has formed a relatively complete system of real estate registration system. So this paper through the introduction and discussion of Japan's real estate registration system and improve the course, and then put forward to perfect our real estate registration system.
This paper is divided into four parts: the first part is the Japanese real estate registration system of history, consists of three sections, the first section is the real estate registration system before the Meiji Restoration; the second section is the real estate registration system to determine the Meiji Restoration period; the third section is the real estate development and development board by this method, the three section introduces the Japanese can understand the development of real estate registration system and improve the process. The second part is the current real estate registration system, mainly on the system and characteristics of the real estate registration system, the registration authority and the registration book, registration classification and registration procedures are introduced. The third part is the Japanese real estate registration potency, focuses on the analysis of the relative confirmation of Japan's unique theory and the elimination of malicious breach of trust registration system. The fourth part is the Enlightenment of the Japanese real estate registration system of our country, the first branch This paper analyzes the current situation and problems of the real estate registration system in China, and then puts forward five perfect measures by drawing on the experience of Japan.
