中国特色社会主义法治概念的重构——以交往行动理论为基础

【摘要】：中国特色社会主义法治是现代法治。现代法治是现代社会及国家的规范与制度结构。质言之,现代社会的社会秩序形成或社会整合的取得是通过或依赖现代法的。这是由现代社会的特性所决定的。现代法治可以被区分为三个层面的法治:个人、系统和国家。中国特色社会主义法治是中国特色社会主义社会及国家的规范与制度结构。与其他现代社会及国家的法治相比较,他的特性在于他是由人民当家作主与中国共产党的领导所构成的。人民当家作主属于第一层面的法治,中国共产党的领导属于第三层面的法治。
[Abstract]:The socialist rule of law with Chinese characteristics is the modern rule of law. The modern rule of law is the norm and institutional structure of the modern society and the country. The formation of social order or the acquisition of social integration in modern society are determined by the characteristics of modern society. The modern rule of law can be divided into three levels: the individual. The rule of law of socialism with Chinese characteristics is the norm and institutional structure of the socialist society with Chinese characteristics and the national system, compared with the rule of law in other modern societies and countries, His characteristic is that he is composed of the people as the master of his own country and the leadership of the Communist Party of China, which belongs to the first level of the rule of law and the leadership of the Communist Party of China to the third level of the rule of law.
