【摘要】：[目的/意义]"斯诺登事件"后,美国情报部门大规模电话元数据监控的合宪性引致美国社会的广泛质疑。如何对美国情报部门大规模电话元数据监控制度进行改革以在国家安全维护和公民权利保障之间取得平衡遂成为无法回避的问题。[方法/过程]通过研究美国情报部门大规模电话元数据监控的发展、制度内容,分析美国联邦法院、国会对大规模电话元数据监控合宪性问题作出的回应。[结果/结论]尽管《自由法案》禁止情报部门根据《爱国者法案》第215条进行大规模电话元数据监控,但这并不意味着情报部门大规模电话元数据监控的终结,情报部门大规模电话元数据监控有待进一步规制和改革。
[Abstract]:[purpose / meaning] after the Snowden incident, The constitutionality of large-scale telephone metadata surveillance by US intelligence services has led to widespread doubts in American society. How to reform the U. S. intelligence mass telephone metadata surveillance system to safeguard national security and civil rights. A balance between safeguards has become an unavoidable issue. [methods / processes] by studying the development of large-scale telephone metadata surveillance in the United States intelligence services, The content of the system, the analysis of the United States Federal Court, Congress's response to the constitutionality of large-scale telephony metadata surveillance. [results / conclusions] although the Freedom Act prohibits intelligence agencies from conducting large-scale telephone metadata surveillance under section 215 of the Patriot Act, However, this does not mean the end of large-scale telephone metadata monitoring by intelligence agencies, which needs further regulation and reform.
