论中国法治建设的过渡期

【摘要】：法治建设有它具体的历史语境。中国在历史传统、宗教习俗、文化经济方面与西方国家有根本的不同,要在这些条件下完成法治的跃进非常困难,况且这些条件还规定了中国的法治不可能照搬西方模式。法治的生成需要慢慢地浸润。这就决定了法治建设不可能在短时间内完成,必须确立一个过渡期。这个过渡期的目的是为了促进法治秩序的形成,而其本质特征表现在必须依靠国家力量的推动。在法治过渡期,需要在把握现实的基础上为法治秩序的到来做好理论上、思想上和制度上的准备。
[Abstract]:The construction of the rule of law has its specific historical context. China is fundamentally different from the western countries in terms of historical traditions, religious customs, and cultural and economic conditions. It is very difficult to complete the leapfrogging of the rule of law under these conditions. Moreover, these conditions also stipulate that the rule of law in China cannot copy the western model. The formation of the rule of law needs to be slowly infiltrated. This determines that the construction of the rule of law cannot be completed in a short period of time. A transition period must be established... the purpose of this transition period is to promote the formation of the rule of law order, and its essential characteristic is that it must be driven by the forces of the State... during the transition period of the rule of law, It is necessary to make theoretical, ideological and institutional preparation for the coming of the rule of law order on the basis of grasping the reality.
