欧洲各国体育立法的经验与启示

【摘要】：综合分析了欧洲各国体育法文本的总体情况,选取意大利、法国、俄罗斯等国的体育法做类型化、典型性分析,并从各国体育法的立法结构、法规内容和立法技术等方面进行了具体分析。研究认为:体育法在各国体育实践中的作用和地位越来越重要,体育权利、政府责任、体育保障以及体育发展中的具体问题都需要体育法进行全面的制度安排和法律保障,科学、民主、现代的体育治理体系需要完善的体育立法提供坚强的保障。欧洲各国体育立法对《中华人民共和国体育法》的修订具有较好的参考借鉴作用。
[Abstract]:This paper comprehensively analyzes the general situation of the sports law texts of European countries, and selects the sports laws of Italy, France, Russia and other countries to do the typological and typical analysis, and from the legislative structure of the sports laws of various countries, This paper analyzes the contents of laws and regulations and legislative techniques. The research shows that sports law plays an increasingly important role in sports practice in various countries, sports rights, government responsibilities, and so on. Sports security and specific problems in sports development require comprehensive institutional arrangements and legal safeguards in the sports law, scientific and democratic, The modern sports governance system needs perfect sports legislation to provide strong guarantee. The sports legislation of European countries has a good reference to the revision of the Sports Law of the people's Republic of China.
