民国时期住房保障的立法和制度的研究

【摘要】：中华民国时期,由于城市人口的剧增和城市发展之间的矛盾,房荒成为严重的社会问题。在孙中山先生“三民主义”的指导下,在英美等国住房保障理论的影响下,国民政府开始就公民住房保障进行立法,并最终形成了公营住宅制度和租房管理制度为核心的住房保障制度。民国时期住房保障的立法是中国历史上第一次对居民的住房权进行立法。在中国住房保障史上具有重要的地位。但由于因为战乱和社会动荡,直到民国结束,这一套保障制度并没有获得很好的实施。民国时期的住房保障制度,为我国现在的住房保障立法提供了有益的经验和教训。特别在房屋救济和出租房屋管理的相关制度上,起到了借鉴的作用。
[Abstract]:During the period of the Republic of China, housing shortage became a serious social problem due to the contradiction between the sharp increase of urban population and urban development. Under the guidance of Sun Zhongshan's "three people's principles" and under the influence of housing security theory in Britain and the United States and other countries, The National Government began to legislate on the housing security of citizens, and finally formed the housing security system with the public housing system and the rental management system as the core. The housing security legislation of the Republic of China is the first time in Chinese history to legislate on the housing rights of residents. It plays an important role in the history of housing security in China. However, because of the war and social unrest, until the end of the Republic of China, This safeguard system has not been well implemented. The housing security system during the period of the Republic of China has provided beneficial experiences and lessons for the present housing security legislation in our country, especially in the relevant systems of housing relief and rental housing management, which has played a reference role.
