中国古代对姓名的法律规制探究

【摘要】：姓名是中华民族文化的重要组成部分，在中国古代更是具有着特殊的地位和作用，从传统法律的角度对姓名进行研究，对全面、深刻的认识中国古代社会有着以小见大的重要意义。本文分主要从四个方面展开：第一部分，，论述在中国古代宗法社会背景下姓名的特殊功能，即别婚姻、明贵贱、招祸福。第二部分，从包括历代法典和皇帝的诏令等在内的国家法角度来论述对姓名的规制，具体从对位尊者姓名的维护和统治者对他人姓名的干预两个方面具体阐述。第三部分，从民间法角度论述对姓名的法律规制，又包括了家法族规和民间一般习惯法两个层面。第四部分，对中国古代社会对姓名的法律规制作简要评价。最后，结语部分一方面阐述姓名权在近现代法律中的逐步确立，另一方面说明现代法律对姓名进行规制的必要性。
[Abstract]:The name is an important part of Chinese culture, has a special status and role in ancient China is, from the traditional legal perspective for the name of research, for comprehensive, profound understanding plays an important role in the ancient society of Chinese the child is father of the man. The fourth part of the ancient society in the name of China Finally, the conclusion part expounds the gradual establishment of name right in modern law, and on the other hand, the necessity of modern law's regulation of names.
