社科法学的传统与挑战

【摘要】：用社会科学的方法来分析法律问题就是社科法学,社科法学是包含社会科学但是又高于社会科学的一种理论。但是目前我国社科法学者受到了法教义学的挑战,这是由于法教义学更为注重逻辑和体系的构建,但是社科法学则注重个案研究。因此社科法学看似杂乱无章、知识零碎,因此为了更好地打破社科法学的发展障碍,加强对社科法学的自我检讨来强化知识传统的认知。
[Abstract]:The social science law is a kind of theory that contains the social science but is higher than the social science. However, at present, the scholars of social science and law in our country are challenged by the doctrine of law. This is because the doctrine of law pays more attention to the construction of logic and system, but the law of social science pays more attention to the case study. Therefore, the law of social science seems to be disorganized and knowledge is fragmented, so in order to better break the obstacles to the development of social science law, Strengthen the self-review of social science law to strengthen the knowledge tradition cognition.
