坚持和创新“德法双治”治理范式

【摘要】：在治国理政的方式上,德治与法治是两个主要手段。纵观中外历史发展,只有实现法治与德治的协同互补,才能形成良好的治理体系,产生好的治理效果。古代中国奉行"德主刑辅"的观念,坚持德法并用,实行"重德轻法"的治国方略。这一治国方略曾产生积极影响,但也有着明显的缺陷。当代中国要推进治理体系和治理能力现代化,就必须坚持问题导向,坚持"德法双治"、德法相济,构建和实施"德上法下""循法成德"的新型治理范式。
[Abstract]:Rule by virtue and rule by law are two main means of governing the country and governing by law.Looking at the historical development of China and foreign countries, only by realizing the cooperation and complementation of rule by law and rule by virtue can a good governance system be formed and a good governance effect can be produced.In ancient China, the concept of "morality dominates punishment and auxiliary punishment", the combination of morality and law, and the strategy of "valuing morality and neglecting law" were adopted.This strategy has had a positive impact, but also has obvious shortcomings.In order to promote the modernization of governance system and governance ability in contemporary China, we must adhere to the problem orientation, adhere to the principle of "the combination of morality and law", and construct and implement the new governance paradigm of "virtue under the law" and "forming virtue by law".
