【摘要】：古代中国追求一种和谐无争的社会秩序,在这样一种理想秩序中,人们不仅没有作恶的行为,而且消除了作恶的心理。正如沈家本在《历代刑法考?寄|文存》卷八之《书明大诰后》中所描述的那样:“昔者三代之民,其心安于为善,而耻于为不善,即间有一、二不善之习,不足以移人。其时,上初不以威为治而以刑驱迫其后也,何其德化盛而风俗茂美如斯哉!”可见,道德教化在我国传统法律文化中的重要地位。早在西周时期,周公提出“明德慎罚”的法律指导思想,并由此发展出教育刑思想。在随后的春秋战国时期,儒家学者对道德教化非常重视,在西周教育刑思想的基础上进一步强调了教育对法律的重要作用。本文就先秦时期的教育刑思想进行梳理,引文部分简要介绍教育刑思想的含义以及学术史回顾。正文分为四个部分。第一部分介绍了西周以前教育刑思想的萌芽以及有关象刑的争议。第二部分介绍了西周教育刑思想及实践,主要从监狱改造制度、誓审制度以及耻辱刑制度三个方面阐述。第三部分介绍了春秋战国时期的儒家教育刑思想。其中分别对孔子、孟子、荀子的教育刑思想进行阐述。第四部分着重介绍了先秦教育刑思想的理论基础,主要从德教观、宗法伦理观、天人观和人性观四个角度论述。最后,在结论部分对教育刑思想的作用及其影响进行评议。本文希望通过对先秦教育刑思想进行整理分析以期对当今社会有所借鉴。
[Abstract]:In ancient China, the pursuit of a harmonious and indisputable social order, in such an ideal order, people not only did not do evil behavior, but also eliminated the psychology of doing evil.As Shen Jiaben did in "the Criminal Law of the past dynasties"?As described in the Book of Letters Patent in Volume 8, "the people of the past three generations are at peace for good, but ashamed to be bad, that is, there is one or two bad habits between them, which are not enough to move people."At that time, at the beginning of the day, not to rule by the Wei, but to force the later with the punishment, how the virtue and customs are so beautiful! "Therefore, moral education plays an important role in Chinese traditional legal culture.As early as the Western Zhou Dynasty, Zhou Gong put forward the legal guiding ideology of "Mingde carefully punish" and developed the thought of educational punishment.In the later Spring and Autumn and warring States period, Confucian scholars attached great importance to moral education, and further emphasized the important role of education to the law on the basis of the Western Zhou Dynasty's thought of educational punishment.This paper combs the thought of educational punishment in pre-Qin period, and briefly introduces the meaning and academic history of the thought of educational punishment in the citation part.The text is divided into four parts.The first part introduces the germination of the thought of educational punishment before the Western Zhou Dynasty and the controversy about elephant punishment.The second part introduces the thought and practice of educational punishment in Western Zhou Dynasty, mainly from three aspects: prison reform system, oath trial system and humiliating punishment system.The third part introduces the Confucian thought of educational punishment in the Spring and Autumn and warring States period.Among them, Confucius, Mencius, Xunzi's thought of educational punishment were expounded.The fourth part mainly introduces the theoretical basis of the pre-Qin education and punishment thought, mainly from the view of moral education, patriarchal ethics, nature and man and human nature.Finally, in the conclusion part, the function and influence of the thought of educational punishment are discussed.This article hopes to arrange and analyze the thought of educational punishment in pre-Qin Dynasty in order to draw lessons from today's society.
