法律论证中的数学方法

【摘要】：在推动人类知识发展的历史进程中,数学呈现出一般方法论的特征。在法律论证过程当中,运用数学知识进行推理、演算和分析,论证案件中的法律命题,形成特定的解释和判断,得出相应的结论,可以实现司法说服。数学本源于人类生活的特性决定了人类可以运用数学方法解释法律现象。运用数学方法进行法律论证,是数学作为方法论的本质展现,也是法律论证的理论升华。在司法实践中,数学方法在法律事实论证和法律适用论证当中能够发挥重要作用。但在司法当中,过度强调数学论证可能会忽视必要的价值考量,偏离法律理性和司法规律,从而导致司法不公。司法经验和法理反思两方面的研讨表明,法律论证应当谨慎对待数学方法,特别是要注重考查关联性,有效发挥数学方法的正能量。
[Abstract]:In the historical process of promoting the development of human knowledge, mathematics presents the characteristics of general methodology. In the process of legal argumentation, using mathematical knowledge to reason, calculate and analyze, to prove the legal proposition in the case, to form a specific interpretation and judgment, to draw the corresponding conclusions, can achieve judicial persuasion. The nature of mathematics originated from human life determines that human beings can use mathematical methods to explain legal phenomena. It is the essence of mathematics as methodology and the theoretical sublimation of legal argumentation to apply mathematical method to legal argumentation. In judicial practice, mathematical method can play an important role in the proof of legal facts and application of law. But in judicature, too much emphasis on mathematical argumentation may ignore the necessary value consideration, deviate from the legal rationality and judicial law, and lead to judicial injustice. The study of judicial experience and reflection of legal theory shows that legal argumentation should treat mathematical methods with caution, especially pay attention to the relevance of examination, and give full play to the positive energy of mathematical methods.
