美国《拜杜法案》介入权改革及其对中国的启示

【摘要】：美国1980年颁布的《拜杜法案》赋予政府机构强制项目承担者向第三方授权或许可发明专利的权力,即介入权。自法案颁布以来,有五个介入权申请的典型案例,但均未成功。为保障政府资助发明在商业化中的公众利益,美国学者认为,需要通过立法改革来平衡介入权的体系设计。这些改革措施包括:设置申诉程序;规定被许可者付出"最大努力"并定期报告;明确《拜杜法案》中的"合理条件";通过公开招标强制许可发明专利。本文借鉴美国介入权立法和改革经验,以期对中国《科技进步法》的进一步完善提供新思路。
[Abstract]:The Baidu Act promulgated by the United States in 1980 gives government agencies the power to authorize or license invention patents to third parties, that is, the right to intervene. Since the enactment of the Act, there have been five typical cases of intervention claims, all of which have not been successful. In order to protect the public interest in the commercialization of government-funded inventions, American scholars believe that it is necessary to balance the system design of the right of intervention through legislative reform. These reforms include: setting up a complaint procedure; requiring licensees to make "best efforts" and reporting regularly; clarifying the "reasonable conditions" in the Baidu Act; and enforcing the licensing of invention patents through open tenders. This paper draws lessons from the experience of American intervention legislation and reform in order to provide new ideas for the further improvement of China's Science and Technology Progress Act.
