基层治理的法治秩序与生成路径

【摘要】：法治秩序是与现实社会紧密结合的、动态的现时状态,法律规范的"合社会性"与社会运行的"合法律性"的有机结合,是法治秩序的理论"两翼"。法治秩序的生成,在于社会事实中"价值"被法律规范所吸纳,然后反作用于社会,进而达致法律规范的普适性与法律适用的统一性。当代中国法治秩序的生成面临着基层乡土性、法律悬浮化、"互联网+"时代等多重挑战,法律体系建成后,应当逐步由秩序建构向自发生成转型,大力培育社会组织并对民众进行公民精神塑造,通过秩序维系所需的"价值"内核的凝聚和融合,最终形成自治自主、多元互依的扁平化社会结构,进而生成契约化的基层法治秩序。
[Abstract]:The order of the rule of law is closely combined with the real society, and the dynamic present state, the organic combination of the "sociality" of the legal norms and the "harmony of the law" of the social operation, is the "two wings" of the theory of the order of the rule of law. The formation of the order of rule of law lies in the fact that "value" is absorbed by the legal norms, and then counteracts on the society, thus achieving the unity between the universality of the legal norms and the application of the law. The formation of the legal order in contemporary China is faced with many challenges, such as the local nature at the grass-roots level, the suspension of law, the era of "Internet", and so on. After the completion of the legal system, the legal system should be gradually transformed from the construction of order to the spontaneous generation. Cultivating social organizations and shaping the civic spirit of the people, through the cohesion and integration of the core of "value" needed to maintain order, finally forming a flat social structure of autonomy and independence and pluralism and interdependence. In turn, the formation of contractual order of the grass-roots rule of law.
