谁该对授权合法性负责——兼谈网络用户信息披露义务

【摘要】：传统出版者与网络服务提供者经授权享有相同的权利但有完全不同的"责任",造成著作权人权利边缘化和空巢化及媒体间的不平等竞争。网络用户对授权合法性负责,网络服务提供者除应当对其取得的转授权合法性负责外,还应承担网络用户信息披露义务。
[Abstract]:Traditional publishers and web service providers are authorized to enjoy the same rights but have completely different "responsibilities", which results in the marginalization of copyright rights, empty nesting and unequal competition among the media. Network users are responsible for the legitimacy of authorization and network service providers should not only be responsible for the legitimacy of transfer authorization but also assume the obligation to disclose information of network users.
