马克思主义文化观视角下我国法治文化建设研究

【摘要】：马克思主义文化观是马克思主义学者关于文化的基本认识,是我们认识和把握文化现象及其发展规律的思想指南。随着改革开放和社会主义现代化的建设,在信息全球化,多种文化相互交织的背景下,马克思主义文化观的引导价值日益凸显,其有助于引导我国社会主义文化建设的正确方向。社会主义法治国家的建设需要一个良好的法治文化氛围,随着依法治国的全面推进,法治文化的相关理论逐渐进入了国内学者的视野,对法治文化的研究也逐步得到重视。法治文化是社会主义文化的重要组成部分,因此,建设社会主义法治文化,就要从我国国情出发,坚持马克思主义文化观的指导,通过对我国法治发展的经验进行总结,从而探寻出适合我国法治文化建设的思路,为我国法治文化的建设奠定一定的理论基础。本文以文化和法治文化的含义作为切入点,通过理论界对法治文化的不同观点,对法治文化的定义进行总结和概括。同时,概括了马克思主义文化观的具体内容,其中包括马克思、恩格斯的文化观、列宁的文化观,以及中国化马克思主义的文化建设理念,最后分别从理论基础上和实践基础上分析了马克思主义文化观对我国法治文化建设的指导意义。通过对当前我国法治文化的现状进行了分析,并论述了我国法治文化建设取得的成就和存在的问题,继而从坚持马克思主义指导理念、坚持党的领导、坚持以人为本、坚持公平正义和程序正当等原则作为我国法治文化建设的切入点,分别从精神层面和制度层面提出了在马克思主义文化观视域下我国法治文化建设的建议。
[Abstract]:Marxist cultural view is the basic understanding of culture by Marxist scholars and the ideological guide for us to understand and grasp the cultural phenomenon and its development law. With the reform and opening up and the construction of socialist modernization, under the background of information globalization and the interweaving of many cultures, the guiding value of Marxist cultural view has become increasingly prominent. It is helpful to guide our socialist cultural construction in the right direction. The construction of socialist country ruled by law needs a good cultural atmosphere of rule of law. With the overall advancement of governing the country by law, the related theories of the culture of rule of law have gradually entered the field of vision of domestic scholars, and the study of culture of rule of law has been gradually attached importance to. The culture of the rule of law is an important part of the socialist culture. Therefore, to build the culture of the rule of law in socialism, we should proceed from the national conditions of our country, adhere to the guidance of Marxist cultural view, sum up the experience of the development of the rule of law in our country. Thus, the author tries to find out the ideas suitable for the construction of the culture of rule of law in our country, and lay a certain theoretical foundation for the construction of the culture of rule of law in China. This paper takes the meaning of culture and culture of rule of law as the starting point, summarizes and generalizes the definition of culture of rule of law through the different viewpoints of the theoretical circle on the culture of rule of law. At the same time, it summarizes the concrete contents of Marxist cultural view, including Marx, Engels' cultural view, Lenin's cultural view, and the cultural construction idea of Sinicized Marxism. Finally, it analyzes the guiding significance of Marxist cultural view to the construction of Chinese legal culture on the basis of theory and practice. This paper analyzes the present situation of the culture of rule of law in our country, and discusses the achievements and problems in the construction of the culture of rule of law in our country. Then, from adhering to the guiding idea of Marxism, adhering to the leadership of the Party and adhering to the people-oriented approach, Adhering to the principles of fairness and justice and due process as the starting point of the construction of the culture of rule of law in our country, this paper puts forward some suggestions on the construction of the culture of rule of law in the view of Marxist cultural view from the spiritual level and the system level respectively.
