传统中国国家观新探——兼及对当代中国政治法律的意义

【摘要】:本文认为家国一体观是传统中国最广泛持久的国家观,它包含两个方面:一是家与国的同构;一是家与国的共理。所谓家与国的同构是指家与国(包括法)都是一体两元主从式多样化的构成,这是它的形式结构;所谓家与国的共理是指国家政治(包括法)道德化,这是它的内涵实质,而贯通它们的是传统中国的道德文化原理。家国一体观是一种适合传统中国且至今还有影响的国家观,但它本质上仍是一种传统的臣民国家观,因此,分析其得失并加以取舍,这既是历史又是现实的课题。对当代中国而言,政治道德化不必要,但对政治和法律(包括为政者和执法者)的道德要求不能放弃,同时充实自由、民主、人权、法治等现代政治原则,以使我们从传统的臣民国家观转变为现代而又不失中国内涵的公民国家观。
[Abstract]:This paper holds that the concept of the integration of family and country is the most extensive and lasting view of state in traditional China, which includes two aspects: one is the homogeneity of family and country, the other is the common theory of family and country. The isomorphism of family and country means that the family and country (including law) are one, and this is its formal structure, and the common principle of home and country means the moralization of national politics (including law), which is the essence of its connotation. And they are the traditional Chinese moral and cultural principles. The concept of integration of family and country is a kind of state view suitable for traditional China and still has influence up to now, but it is still a traditional state view of subjects in essence. Therefore, it is a historical and realistic subject to analyze its gains and losses and to choose and choose between them. For contemporary China, political moralization is unnecessary, but the moral requirements of politics and law, including for politicians and law enforcers, must not be abandoned, and modern political principles such as freedom, democracy, human rights, the rule of law, etc., can be enriched at the same time. In order to change us from the traditional state view of subjects to the modern and without losing the Chinese connotation of the concept of citizenship.
