浅析经济特区授权立法

【摘要】：中国经济特区创办30年多来,在建立适应外向型市场经济发展的法律体系方面作了许多有益的探索和尝试。经济特区授权立法制度是改革开放条件下产生的一种新型授权立法。这项新型授权立法在推动经济特区经济与法制建设中发展了积极的作用,并通过《中华人民共和国立法法》予以了制度化。但是在现有制度下,在实践操作中,经济特区的授权立法存在着授权范围笼统、授权权限不明晰、授权监督不完善等问题,一定程度上制约了经济特区授权立法积极作用的充分发挥。本文通过对经济特区授权立法制度的全面考察,并结合工作上的实践,对在现有体制下如何更好地完善经济特区授权立法制度提出了思考,以期充分发挥这一独特制度优势,服务经济特区经济社会发展。全文分为四章：第一章对授权立法及经济特区授权立法进行概述。第二章论述经济特区授权立法的权限、监督制度及授权立法在经济特区建设发展中发挥的作用。第三章分析经济特区授权立法的特点,着重与经济特区“一市两法”的职权立法进行比较。第四章结合笔者工作实际,对如何用好经济特区授权立法权、完善授权立法等实践问题进行了思考和探讨。
[Abstract]:Since the establishment of China's special economic zones (SEZs) more than 30 years ago, many useful explorations and attempts have been made in establishing a legal system adapted to the development of an extroverted market economy. The special economic zone authorization legislation system is a new type of authorization legislation produced under the condition of reform and opening up. This new type of enabling legislation has developed a positive role in promoting the economic and legal construction of special economic zones, and has been institutionalized through the legislation Law of the people's Republic of China. However, under the existing system and in practice, there are some problems in the authorization legislation of special economic zones, such as the general scope of authorization, unclear authorization authority, imperfect authorization supervision, etc. To a certain extent, it restricts the full play of the positive role of the special economic zone (SEZ) legislation. Based on the comprehensive investigation of the legislative system of authorization of special economic zones and the practice of work, this paper puts forward some thoughts on how to better improve the legislative system of authorization of special economic zones under the existing system, with a view to giving full play to this unique system advantage. Serve the economic and social development of special economic zones. The full text is divided into four chapters: The first chapter summarizes the enabling legislation and the special economic zone authorization legislation. The second chapter discusses the authority of the special economic zone (SEZ), the supervision system and the role of the authorized legislation in the construction and development of SEZs. The third chapter analyzes the characteristics of the special economic zone (SEZ) authorization legislation, and compares it with the power legislation of the SEZs "one city two laws". In the fourth chapter, the author thinks and probes into how to make good use of the legislative power of the special economic zone and how to perfect the legislative power of the special economic zone.
