西夏《天盛律令》中婚姻制度研究

【摘要】:西夏王朝是我国历史上以党项羌为主体民族的少数民族政权,历时长达百余年。西夏立国后,不断致力于法制建设,形成了丰富的立法成果。作为西夏法制建设的集大成者,《天盛改旧新定律令》(以下简称为《天盛律令》)是中国历史上第一部用少数民族文字刊行的法典,是我国历史上少数民族政权法制建设杰出成就的代表之一,具有十分高的研究价值。但令人遗憾的是,对于西夏法制的研究还是较为薄弱的环节。 本文以《天盛律令》中婚姻制度的相关规定为切入点,详细阐述西夏社会的婚姻制度,以求更加深刻认识西夏的婚姻制度以及西夏的社会状况,弘扬民族法律文化,丰富中华法系内容;同时,通过对西夏婚姻制度和特色的研究,从西夏的立法中发掘对当代立法的一些历史启示。 本文分为导论和正文两大部分,导论主要介绍本文的选题意义、研究现状以及研究方法;正文分为四章。 第一章“西夏社会和《天盛律令》”,第一节从党项内迁、西夏建国,以及西夏的地理环境、民族情况等方面论述了西夏社会概况,指出党项羌以向中原地区内徙为契机,学习和吸收中原地区先进的技术文化,从而使自身得到了快速的发展,建立起以党项羌为主体、多民族的西夏王朝。第二节主要介绍了《天盛律令》的主要内容、成书年代以及成书的时代背景。 第二章“西夏《天盛律令》中的婚姻制度”,包括结婚制度、婚姻解除制度和其他制度。婚姻的成立需要有合法婚龄、媒妁之言、父母主婚以及相当的婚价和嫁妆;同时《天盛律令》对婚姻的成立还有禁止性的规定,如同姓不婚、禁止抢婚和一女二嫁等。婚姻的解除有“七出”、“三不去”和“和离”制度。此外,《天盛律令》中还规定了其他相关制度,如悔婚、改嫁和私奔的规定。 第三章“西夏婚姻制度的特色及成因”,笔者总结出几点西夏婚姻制度的民族特色:规范性条文较多、一夫多妻制、中表婚盛行、有限制的婚期、女子地位较高、较为宽松的门第观念,并且分析了西夏婚姻制度民族特色形成的原因,主要包括恶劣的自然环境、复杂的社会形态、阴碍封建进程的宗族势力和独特的文化风俗四个方面。 第四章“西夏婚姻制度对我国当代立法的历史启示”,通过对西夏婚姻制度的阐述,笔者总结出西夏的立法精神,即学习精神和创造精神,并且认为这种精神对我国当代立法具有启示作用。 结语部分,笔者对西夏婚姻制度进行了总结,提出写作中的一些不足之处,希望能够起到抛砖引玉的作用,引发方家思考,促进对西夏法制、西夏社会以及对我国当代立法的研究。
[Abstract]:Xixia Dynasty is a minority regime with the party Xiang Qiang as the main ethnic group in the history of our country, which lasted for more than 100 years. After the establishment of the Western Xia Dynasty, it devoted itself to the construction of the legal system and formed rich legislative achievements. As an integral part of the construction of the Xixia legal system, the "Tiansheng Law order" (hereinafter referred to as "Tiansheng Law") was the first code in Chinese history to be published in minority languages. It is one of the outstanding achievements in the legal system construction of minority political power in the history of our country, and has very high research value. However, unfortunately, the study of the Xixia legal system is still a relatively weak link. Based on the relevant provisions of marriage system in Tiansheng Law and order, this paper expounds the marriage system of Xixia society in detail, in order to understand the marriage system of Xixia and the social situation of Xixia in order to carry forward the national legal culture. At the same time, through the study of the marriage system and characteristics of the Xixia Dynasty, some historical revelations to the contemporary legislation are explored from the legislation of the Xixia Dynasty. This paper is divided into two parts: introduction and text. The introduction mainly introduces the significance of the topic, research status and research methods; the text is divided into four chapters. In the first chapter, "the society of Xixia and the decree of Tiansheng", the first section discusses the general situation of the society of Xixia from the aspects of the internal migration of the Party, the founding of the State of the Xixia, the geographical environment and the national situation of the Xixia, and points out that the Party and the Qiang take the opportunity of moving inward to the Central Plains. By studying and absorbing the advanced technology culture in the Central Plains region, we developed ourselves rapidly and established a multi-national Xixia dynasty with the party Xiang Qiang as the main body. The second section mainly introduces the main contents of Tiansheng Law, the writing age and the background of the book. The second chapter is "Marriage system in Xixia", including marriage system, marriage dissolution system and other systems. The establishment of marriage requires legal marriage age, matchmaker's words, parents' dominant marriage and the equivalent marriage price and dowry. At the same time, the law of Tiansheng also prohibits marriage from being established, such as marriage without marriage, robbery and marriage with one daughter and two marriages. The dissolution of marriage has the system of "seven out", "three not going" and "leaving". In addition, Tiansheng decree also provides for other relevant systems, such as marriage, remarriage and elopement. In the third chapter, "the characteristics and causes of the Xixia marriage system", the author summarizes the national characteristics of the Xixia marriage system: there are more normative provisions, polygamy, the prevalence of marriage, restricted marriage, the status of women is higher. The author also analyzes the reasons for the formation of the national characteristics of the marriage system in the Western Xia Dynasty, including the harsh natural environment, the complex social formation, the clan influence which hinders the feudal process and the unique cultural customs. The fourth chapter, "the historical enlightenment of the Xixia marriage system to our contemporary legislation", through the exposition of the Xixia marriage system, the author summarizes the Xixia legislative spirit, that is, the study spirit and the creative spirit. And think this kind of spirit to our country contemporary legislation has enlightenment function. In the conclusion part, the author summarizes the marriage system of Xixia, and puts forward some deficiencies in writing, hoping to play a role of drawing the jade, arousing the thinking of Fang Jia, and promoting the legal system of Xixia. The study of Xixia society and the contemporary legislation of our country.
