宋代军事法律制度探析

【摘要】：自唐代安史之乱以后，武人跋扈，全国藩镇割据，军阀混乱。军队中将帅士兵无视法纪，骄纵叛上，历史上呈现出一派纷扰混乱的军政局面北宋政权建立以后，宋朝统治者着手整顿军政，制定了一系列的军事法律制度，以巩固政权。本文写作不仅要将宋代军事法律制度的基本内容阐明，同时还欲寻求其背后的法律文化，包括其产生的军事法律文化大背景和具体法律制度所体现的军事法律文化传统。全文除引言、结语外主要是分三部分组成。引言部分是对研究课题作出说明。本部分主要对选题的目的、意义、研究状况、资料收集情况以及研究方法作了说明，同时对本文研究的对象和相关的背景作了简单的介绍。正文部分则按照宋代军事法律制度的基本内容、特征和所体现的法律文化传统的顺序展开讨论。第一部分论述宋代军事法律制度的基本内容，包括军事刑法制度、军事行政制度、军事司法制度三个方面。第二部分主要论述宋代军事法律制度的基本特征，主要包括了四个方面的特征。第三部分是结合宋代军事法律制度产生的法律文化背景讨论宋代军事法律制度的所体现的法律文化传统，，主要是从儒学的复兴和义利观的变化两个方面展开分析。
[Abstract]:Since the Tang Dynasty Anshi Rebellion, the military domineering, the national separation of towns, warlords chaos. The generals and soldiers in the army disregarded the law and discipline and were conceited and betrayed. After the establishment of the Northern Song regime, the rulers of the Song Dynasty began to rectify the military and government, and formulated a series of military legal systems to consolidate the regime. This paper not only expounds the basic content of the military legal system in Song Dynasty, but also seeks the legal culture behind it, including the background of the military legal culture and the tradition of military legal culture embodied in the specific legal system. In addition to the introduction, the conclusion is mainly composed of three parts. The introduction part is to make the explanation to the research topic. In this part, the purpose, significance, research situation, data collection and research methods of the topic are explained, and the research object and related background are briefly introduced. The text is discussed according to the basic content, characteristics and legal cultural tradition of the military legal system in Song Dynasty. The first part discusses the basic contents of the military legal system in Song Dynasty, including the military criminal law system, the military administrative system and the military judicial system. The second part mainly discusses the basic characteristics of the Song Dynasty military legal system, mainly including four aspects of the characteristics. The third part is to discuss the legal cultural tradition embodied in the military legal system of the Song Dynasty in combination with the legal cultural background of the military legal system of the Song Dynasty, mainly from the two aspects of the revival of Confucianism and the change of the concept of righteousness and benefit.
