民国时期西藏宗教法制的政治学研究——以《喇嘛转世办法》为例

【摘要】：《喇嘛转世办法》在民国时期西藏宗教法制中占有独特地位,是民国中央政府管理藏传佛教活佛的重要法规。文章阐述了《喇嘛转世办法》的孕育与产生过程,从政治制度设计的方向研究了《喇嘛转世办法》的制度性、规范性与程序性设计,总结了《喇嘛转世办法》的政治与法律考量,并揭示了这一办法对当今民族法制建设的启示。
[Abstract]:The reincarnation method of Lamas occupies a unique position in the religious law of Tibet during the period of the Republic of China, and is an important law of the Central Government of the Republic of China for the administration of living Buddhas of Tibetan Buddhism. This paper expounds the gestation and production process of Lama reincarnation method, and studies the institutional, normative and procedural design of Lama reincarnation method from the direction of political system design. This paper summarizes the political and legal considerations of the Lamas reincarnation method, and reveals the enlightenment of this method to the construction of the present national legal system.
