清代蒙古地区司法审判若干问题研究——以《土默特左旗档案馆藏清代蒙古文档案》所载案例为说

【摘要】：在清朝政府形成的过程中,清政府对包括土默特地区在内的蒙古地区漠南蒙古和漠北蒙古各自实施不同行政管理模式的同时,针对蒙古地区制定《蒙古律例》,以期国家法在蒙古地区能够顺利实施。然而,因法的制定与法的实施之间不能同步的缘故,国家法在蒙古地区实施的过程,必然显现出或遇阻力、或变通执行、或经历与少数民族习惯法之间的博弈过程,或等待包括当地司法官在内的民众的熟悉适用国家法的转变。土默特蒙古文档案记载的台吉(蒙古族贵族)偷窃大畜案所涉若干司法审判问题,在一定程度上反映了《蒙古律例》作为国家法在当时的归化城土默特地区以及蒙古地区的实施情况。
[Abstract]:In the process of the formation of the Qing government, the Qing government implemented different administrative modes on the Mongolia region, including the Tumert region, in the desert south Mongolia and the desert north Mongolia respectively. In order to ensure the smooth implementation of the national law in Mongolia region, this paper formulates Mongolian laws and regulations. However, due to the lack of synchronization between the enactment of the law and the implementation of the law, the process of the implementation of the national law in Mongolia is bound to show resistance, or alternative implementation, or experience a game process with the customary law of the minority nationalities. Or wait for the people, including local magistrates, to become familiar with the change in the application of national law. A number of judicial issues related to the theft of large livestock by Taiji (Mongol aristocracy) recorded in the Tumert Mongolian file, To a certain extent, it reflects the implementation of the Mongolian Law as the national law in Tumert, the naturalized city at that time, as well as in Mongolia.
