法律金融学理论——印度反例研究与中国借鉴

【摘要】："法律与金融"论是诞生于美国的新兴交叉学科,试图以各国的法律渊源、法系与投资者保护法律水平之高下,来解释各国金融发展水平的差异。而其反对者亦提出"政治选择"、"行业结构"决定论等理论加以反驳。本文将以印度这一普通法系传统的、有代表性的发展中国家作为实证案例,通过分析其经济与金融结构、金融法律改革进程、普通法系司法效率、利益集团影响立法、计划经济时期的政治选择等因素,来验证上述两派理论对于发展中国家现实适应性,并希望能从其现实状况与理论研究比较的结论中,得出对于未来中国的金融法治建设有所助益的经验借鉴。
[Abstract]:The theory of "law and finance" is a new interdisciplinary discipline born in the United States. It tries to explain the differences in the level of financial development between different countries by means of their legal sources, legal system and the level of investor protection law. Its opponents also put forward "political choice", "industry structure" determinism and other theories to refute. This paper will take India, a traditional and representative developing country of common law system, as an empirical case, by analyzing its economic and financial structure, the process of financial law reform, the judicial efficiency of common law system, and the influence of interest groups on legislation. Factors such as political choice in the planned economy period are used to verify the adaptability of the two theories to the reality of developing countries, and it is hoped that from the conclusion of the comparison between the actual situation and the theoretical research, Draw on the future of China's financial construction of the rule of law has some useful experience.
