清代群体性事件的法律应对

【摘要】：群体性事件在清代不同时期均有发生,不同规模和形式的人群聚合,聚众闹署、逞凶斗殴、烧杀抢掠的骚乱与冲突,实际上是在社会环境变迁、国家政策制度缺失等多重因素的综合作用下,社会矛盾激化的缩影。综合分析,清代群体性事件发生的原因主要有战争、人地矛盾、贪污腐败等。针对群体性事件频发,清政府从立法、司法、国家政策调整等多个角度来应对,如颁布专门性的法律条例、整饬吏治、改革赋税制度等等。社会危机的出现,通常能将某些潜隐不易觉察的社会问题暴露出来,群体性事件的井喷式爆发往往也是发生社会危机的预兆。加强政府的法律控制和社会管理能力,营造一个机会平等的社会,设计和完善社会预警制度,这是中国传统和现代社会同样需要积极面对的问题。
[Abstract]:Mass incidents occurred in different periods of the Qing Dynasty. In fact, the riots and conflicts of different scales and forms of crowd gathering, gathering of people, fighting, burning, killing and looting were actually changing in the social environment. Under the comprehensive action of many factors, such as the absence of national policy system, the social contradiction intensifies in microcosm. The main causes of group incidents in Qing Dynasty are war, contradiction between people and land, corruption and so on. In view of the frequent occurrence of mass incidents, the Qing government responded from the aspects of legislation, judicature, national policy adjustment and so on, such as promulgating special laws and regulations, rectifying the administration of officials, reforming the tax system, and so on. The emergence of social crisis usually exposes some hidden and undetectable social problems, and the blowout explosion of group events is also a harbinger of social crisis. Strengthening the government's legal control and social management ability, creating a society with equal opportunities and designing and perfecting the social early warning system are the same problems that Chinese traditional and modern society should face.
