论黎族民间法律秩序的建构

【摘要】：黎族作为海南岛的原住民,为了能够维护本群体生产、生活秩序的稳定,在千百年的生产、生活实践中,通过历史的演变逐渐形成了道德、宗教、习惯相互融合的黎族民间法律规范,并逐渐上升成为具有在黎族地区极强社会控制力的黎族民间法律秩序。黎族地区的民间法律秩序在维护社会利益、维持内部秩序、调整社会关系、促进民族地区的安定和发展中发挥着重要作用。时至今日,黎族民间法律秩序仍在社会控制上发挥着积极的作用,在黎族社会中发挥着良好的实效。对黎族民间法律秩序的分析,不论是对于了解黎族内部规则的发展还是剖析黎族类社会的民间秩序进化轨迹来说都是具有十分重要意义。 本文用法社会学方法,历史研究的方法以及实证分析的方法对黎族民间法律秩序的历史演变、规则体系建构、价值选择、社会控制主要内容进行剖析,分析黎族民间自治力量如何依靠民间法律规范对社会秩序进行调控,力求从“本土资源”中挖掘出对于中国法制建设进程有益的因素,为中国法治的建设提供不同的思考角度,以期对现代国家法治建设事业提供可资借鉴之处。本文的创新之处在于从黎族民间法律秩序漫长的历史演变和现实有效性中,提取出确立民间法律秩序的三项内在价值；对黎族民间法律秩序的调控范围进行分析；分析黎族民间法律规范作为中国多元法律体系的一部分,与国家法存在互补性。
[Abstract]:Li, as a native of Hainan Island, in order to maintain the stability of the production and living order of this group, in the course of thousands of years of production and life practice, through the evolution of history, gradually formed a moral, religious, The folk legal norms of Li nationality, which are used to merge with each other, have gradually become the legal order of Li nationality with strong social control in Li nationality area. The folk legal order in Li nationality area plays an important role in maintaining social interests, maintaining internal order, adjusting social relations and promoting the stability and development of minority areas. Up to now, the folk legal order of Li nationality still plays a positive role in social control, and plays a good practical effect in Li nationality society. The analysis of the legal order of the Li nationality is of great significance to understand the development of the internal rules of the Li nationality and to analyze the evolution of the civil order of the Li nationality society. This paper analyzes the historical evolution, rule system construction, value selection and social control of the folk legal order of Li nationality by using the methods of sociology, historical research and empirical analysis. This paper analyzes how the Li nationality folk autonomy forces regulate and control the social order by relying on the folk legal norms, and tries to find out the beneficial factors from the "local resources" for the process of China's legal construction, and to provide different thinking angles for the construction of the rule of law in China. In order to provide a reference for the cause of the construction of modern national rule of law. The innovation of this paper is to extract the three intrinsic values of establishing the folk legal order from the long historical evolution and practical validity of the folk legal order of Li nationality, to analyze the scope of regulating and controlling the folk legal order of Li nationality. As a part of the pluralistic legal system of China, the folk legal norms of Li nationality are complementary to national law.
