马锡五法律思想对“青天文化”的继受与发展

【摘要】："青天"是古代市民社会对于良吏、循吏、廉吏、清官等概念之兼容,反映了百姓对监临主司体恤民瘼、执法严明、清廉公正等诸多期许。在抗日战争的特殊历史时期形成的"马锡五审判方式"是我党群众路线在司法审判实践中的集中体现,而马锡五"青天"形象的形成与传播,则是传统"青天"文化在新民主主义时期司法工作中成功运用。"青天"是广大人民群众喜闻乐见的艺术形象,是长期吏治文化与法律文化积淀的历史产物,更是有效落实司法领域沟通天理、国法、人情的优秀途径。
[Abstract]:"Qingtian" is the compatibility of the ancient civil society for good officials, honest officials, clean officials and other concepts, reflecting the people's understanding of the Lord's suffering, strict law enforcement, clean and fair and many other expectations. The "Ma Xi-wu trial method" formed in the special historical period of the Anti-Japanese War is the concentrated embodiment of our party's mass line in the judicial trial practice, and the formation and dissemination of Ma Xi-wu 's "Qingtian" image. The traditional "Qingtian" culture was successfully applied in the judicial work of the new democratic period. " "Qingtian" is a popular artistic image of the broad masses of the people, a historical product of the long-term accumulation of the culture of officials and law, and an excellent way to effectively carry out the communication between heaven, state law and human feelings in the judicial field.
