原告适格论

【摘要】：撤销诉讼,可以说是日本行政诉讼当中,最为传统也是最具典型意义的诉讼形态。而撤销诉讼的提起,必须具备一定的"诉的利益"(原告适格、狭义的诉的利益、行政处分性)。撤销诉讼的原告适格,是指提起撤销诉讼的资格的问题。尽管现行《行政案件诉讼法》第9条第1款规定,"对请求撤销处分或裁决具有法律上的利益者",具有提起撤销诉讼的原告资格,但是,由于该法并没有明确界定何谓"法律上的利益",因此,原告适格论,实际上也就演变成为"法律上的利益"的解释论。对此,传统上存在着两种对立的观点:"法律上所保护的利益说"和"值得保护的利益说"。本文在对日本行政法学上的原告适格论做一个整体概观之后,以当今最高法院有关原告适格尤其是第三人的原告适格的典型判例为素材,梳理并详细分析了该理论的发展脉络,并对未来的发展方向做了展望。
[Abstract]:Rescission litigation is the most traditional and typical litigation form in Japanese administrative litigation. However, the institution of rescission action must have certain interest of action (plaintiff's qualification, narrow lawsuit's benefit, administrative disposition). The qualification of the plaintiff in the annulment action refers to the question of the qualification of the action of rescission. Although article 9, paragraph 1, of the current Code of procedure for Administrative cases provides that "a person who has a legal interest in requesting a disposition or award to set aside" is qualified as a plaintiff to initiate a cassation action, Since the law does not clearly define what is meant by "legal interest", therefore, the plaintiff's eligibility theory actually evolves into the interpretation of "legal interest". Traditionally, there are two opposing viewpoints: the theory of interests protected by law and the theory of interests worth protecting. After making an overall overview of the theory of plaintiff qualification in Japanese administrative law, this paper, based on the typical cases of the Supreme Court concerning the plaintiff qualification, especially the third party's plaintiff qualification, sorts out and analyzes in detail the development of the theory. The future development direction is also prospected.
