美国版权法改革及其对出版业的影响

【摘要】：从2010年1月"版权原则项目组"发表《版权原则项目:改革方向》报告,到2016年12月美国众议院司法委员会发布《改革美国版权局》的司法提案,美国版权法正在进行全面改革。美国出版商协会作为创造者代表全面参与了版权法改革,积极表达修改旧"避风港规则"的"通知—删除"机制为新的"通知—永久删除"机制,而这一提议已经成为美国版权局和美国众议院司法委员会立法议题。鉴于近年来欧盟国家版权法改革实践,这一新"避风港规则"虽然遭到网络服务商的反对,最终却极有可能写入立法。而新规则的拟定,将使传统内容出版商迎来春天,出版传播商业平台尤其是UGC出版平台将面临侵权注意义务的巨大挑战。
[Abstract]:From the publication of the report on the copyright principles Project: directions for Reform by the copyright principles Project Group in January 2010 to the release of a judicial proposal by the US House of Representatives Judiciary Committee in December 2016, American copyright law is undergoing a comprehensive reform. The American Publishers Association, as the creator's representative, has been fully involved in copyright law reform, actively expressing the "Notification-Delete" mechanism for modifying the old "safe haven" rules as the new "Notification-permanent Delete" mechanism, The proposal has been the subject of legislation by the U.S. copyright Authority and the House Judiciary Committee. In view of the practice of copyright law reform in European Union countries in recent years, this new "haven rule", though opposed by network service providers, is likely to be written into legislation. The drafting of new rules will bring spring to the traditional content publishers, and the publishing and dissemination business platform, especially the UGC publishing platform, will face the huge challenge of tort duty of care.
