从基本权利的角度解释美国的联邦集权

【摘要】：美国联邦宪法的发展过程呈现出联邦权力扩大和加强的趋势。对这个趋势的理解存在一个民主范式,认为其中的规范性动力来自民主。然而,对这个趋势的理解必须联系美国联邦宪法的另一个总体趋势,那就是该宪法从权力规则向权利宪章的发展。美国宪法史的解释也表明,联邦集权的规范性动力正是来自联邦政府同州政府在基本权利保卫者角色上的竞争关系,权力从州向联邦的转移和集中,是以基本权利为中介的,是通过权利的权力集中。基本权利之所以具有这样的枢纽功能,端在于基本权利具有普遍性。从基本权利普遍性的角度出发,联邦制可以被理解为一个世界性的课题。
[Abstract]:The development of the federal constitution of the United States shows a trend of expansion and strengthening of federal power. There is a democratic paradigm in the understanding of this trend, and the normative power comes from democracy. However, an understanding of this trend must be linked to another general trend in the United States federal constitution, which is the evolution of the constitution from the rules of power to the charter of rights. The interpretation of the American constitutional history also shows that the normative impetus of federal centralization comes from the competitive relationship between the federal government and the state government in the role of guardian of fundamental rights. The transfer and centralization of power from state to federal is mediated by basic rights. It is through the centralization of power. The reason why basic rights have such a pivotal function lies in the universality of basic rights. From the point of view of universality of fundamental rights, federalism can be understood as a worldwide subject.
