美国住房抵押贷款消费者保护立法研究

【摘要】:本文从次贷危机后美国《Dodd——Frank法案》的最新立法入手,研究了美国住房抵押贷款消费者保护的最新进展,从中找出对我国立法的借鉴意义。本文分四部分组成。 第一部分,介绍了次贷危机发生演变的过程,对次贷危机的产生原因进行了初步归纳;通过对次贷危机本身的辨识,结合次贷危机之前的住房抵押贷款消费者保护立法,提出原有立法面临的问题和挑战,从而引出以下的内容。 第二部分,介绍了美国住房抵押贷款改革的最新情况,先介绍了立法的宏观目标(明确的宏观目标是本次立法的特点之一);然后介绍了次贷危机爆发后的立法准备,包括主要的研究成果;接下来介绍了《Dodd——Frank法案》的主要内容,尤其是深化了对消费者的保护;最后澄清了最新立法对房利美、房地美的态度——肯定两房的作用,从而说明应当改革的是弥补原先的监管空白——次贷营销中不公、不实、过度的业务领域。 第三部分对《Dodd——Frank法案》进行了几方面的分析,关于宏观目标和微观目标;关于深化了的消费者定义;以及专门设立消费者服务机构。 第四部分对《Dodd——Frank法案》消费者保护立法进行了评价,其特点包括监管目标明确,制度深入详细直达金融产品的核心,也就质疑该立法的意见进行了阐述;最后归纳了其中的借鉴意义,并提出对我国未来立法的建议。
[Abstract]:This paper begins with the latest legislation of the Dodd--Frank Act in the United States after the subprime mortgage crisis, and studies the latest progress in the protection of American housing mortgage consumers, and finds out the significance of reference to the legislation of our country. This paper is composed of four parts. The first part introduces the process of the development of the subprime mortgage crisis, and summarizes the causes of the sub-prime mortgage crisis. Through the identification of the sub-prime mortgage crisis itself, combined with the housing mortgage consumer protection legislation before the sub-prime mortgage crisis, the problems and challenges faced by the original legislation are put forward, which leads to the following contents. The second part introduces the latest situation of the housing mortgage reform in the United States, first introduces the macro objectives of the legislation (one of the characteristics of this legislation is the clear macro objectives); Then it introduces the legislative preparation after the outbreak of the sub-prime mortgage crisis, including the main research results, and then introduces the main contents of the "Dodd--Frank Act", especially the deepening of consumer protection; Finally, it clarifies the attitude of the latest legislation to Fannie Mae and Freddie Mac-affirming the role of Fannie and Freddie, thus suggesting that what should be reformed is to fill the original regulatory gap-unfair, untrue, and excessive areas of business in subprime marketing. The third part has carried on several aspects analysis to the "Dodd--Frank Act", regarding the macroscopic goal and the microscopic goal; regarding the deepened consumer definition; and specially establishes the consumer service organization. The fourth part of the "Dodd--Frank Act" consumer protection legislation has been evaluated, its characteristics include clear regulatory objectives, the system goes to the core of financial products in detail, and the views of questioning the legislation are expounded. Finally, it summarizes the significance of reference, and puts forward some suggestions for future legislation of our country.
