立法项目论证制度研究

【摘要】：立法项目论证是指特定的组织按照一定的程序和标准就若干个立法建议项目进行审查评议,并最终确定纳入立法规划的活动。立法项目论证在我国部分省市已经开始试行,并形成了相应的制度,但目前尚存在诸多问题:立法项目论证的层次比较低、立法项目论证缺乏统一的制度、立法项目的选定范围狭窄、立法项目论证虎头蛇尾等。为了提高立法质量,立法项目论证应该规范化、制度化:立法项目论证的内容主要包括立法申请项目的必要性、可行性、合法性、公平性论证、协调性以及效益和成本;立法项目论证应当具有一定的法律效力;纳入立法规划的立法项目的标准是"良法"+"应急"。立法项目确定该选择"专家建议+人大确定"模式。对于"良法"+"应急"的立法项目应当列入立法规划,仅具有良法性质但不急待立法的可以暂缓列入立法规划,既没有"良法"性质,又没有必要的,不予立项。
[Abstract]:Legislative project argumentation refers to the specific organization according to certain procedures and standards to review and comment on several legislative proposals and finally determine the activities to be included in the legislative plan. Legislative project argumentation has been tried out in some provinces and cities of our country, and the corresponding system has been formed. However, there are still many problems at present: the level of legislative project argumentation is relatively low, and the legislative project argumentation lacks a unified system. The scope of selection of legislative items is narrow, and the legislative items are discussed. In order to improve the legislative quality, the legislative project argumentation should be standardized and institutionalized: the content of the legislative project argumentation mainly includes the necessity, feasibility, legitimacy, fairness argument, coordination, benefit and cost of the legislative application project; The legislative project argumentation should have certain legal effect, and the standard of the legislative project included in the legislative plan is "good law" emergency ". The legislative project determines the choice of the "expert recommendation to the National people's Congress to determine" mode. For the "good law" emergency "legislative items should be included in the legislative planning, only good law nature but not urgent legislation can be suspended into the legislative planning, neither" good law "nature, and not necessary, no project.
