平衡法理论与法治中国建设

【摘要】：平衡法理论根植于我国现实国情和法治实践,吸收中西方经典平衡法治思想精华,以平衡法哲学研究范式催生法学理论的再度创新,与中国特色社会主义法治理论具有内在一致性;平衡法理论的基本观点包括平衡法本体论、历史论、价值论、关系论、运行论、应用论、发展论和保障论等,丰富了法的基本范畴,旨在调整、缓和和消弭我国社会转型期的权利、权力和义务三者之间六个方面的失衡失序;平衡法理论开辟法治中国建设新的视角,关照人类文明幸福,有助于促进社会和谐、国家安全和世界和平发展,具有重大的理论和学术价值。
[Abstract]:The theory of balanced law is rooted in the reality of our country and the practice of ruling by law, and absorbs the essence of the classical thought of balanced rule of law between China and the West, and accelerates the innovation of the theory of law with the research paradigm of philosophy of balance law. It is consistent with the theory of socialist rule of law with Chinese characteristics. The basic viewpoints of the theory of balance law include the ontology of balance law, the theory of history, the theory of value, the theory of relation, the theory of operation, the theory of application, the theory of development and the theory of guarantee, which enrich the basic category of law and aim at adjusting it. To alleviate and eliminate the imbalance between rights, power and obligation in the period of social transformation; The theory of balance law opens up a new angle of view for the construction of China under the rule of law, takes care of the happiness of human civilization, and contributes to the promotion of social harmony, national security and the peaceful development of the world. It has great theoretical and academic value.
