法律感情探微

【摘要】：法律感情是一个有着特定内涵与外延的概念。它是人在与法律互动过程中形成的具有法律社会意义的情感态度和情感行动,是人的情感法律化的结果。从外延上法律感情涉及到人性本情、民情民意、情节情状和人情情面这四个维度。在法律这个往往被视为最理性的领域,无论是积极感情还是消极感情都发挥到了极致。法律理性是法律交响乐中的主旋律,作为"副旋律"的法律感情之作用大体可分为呼应式、背景式和对比式三种类型。法律体系结构呈现三个世界,法律感情是法律主观结构(世界2)中的一个重要内容,与法律理性形成互补关系。这两个截然不同的侧面,使法律世界的镜像更为真实,形象更为丰满。
[Abstract]:Legal sentiment is a concept with specific connotation and extension. It is the result of the legalization of human emotion, which is formed in the course of the interaction between human beings and the law. From the extension, the legal emotion involves the four dimensions of human nature, public opinion, plot and human feelings. In the field of law, which is often regarded as the most rational, both positive and negative feelings are brought into full play. Legal rationality is the main melody in legal symphony, and the function of legal emotion as "secondary melody" can be divided into three types: echo type, background type and contrast type. The legal system structure presents three worlds, and legal emotion is an important part of the legal subjective structure (World 2), which forms a complementary relationship with legal rationality. These two completely different sides make the mirror image of the legal world more real and the image more full.
