立法与立法正义的实现

【摘要】：立法正义的本质是分配正义,它构成法律正义的第一道门槛。保证立法的正义性已成为当今民主国家立法面临的最大难题。立法正义必须符合道德与法制两方面的标准。立法正义的基本标准是:立法要保障人权,倡导以人为本;要尊重公序良俗,倡导社会诚信;要保护私权,留出道德余地;要符合制度的规范形态。我国需要完善现有立法,推进立法正义的实现。应当校正立法的宗旨,弘扬法律的正义价值;坚持立法民主化,畅通民众参与立法的渠道;倡导立法程序公开,保障利益主体公平博弈;加强立法审查,做好法律清理与备案工作。
[Abstract]:The essence of legislative justice is distributive justice, which constitutes the first threshold of legal justice. To ensure the justice of legislation has become the biggest problem in the legislation of democratic countries. Legislative justice must conform to the standards of morality and legal system. The basic standards of legislative justice are: legislation should protect human rights, advocate people-oriented; should respect public order and good customs, advocate social integrity; protect private rights, leave moral leeway; and conform to the standard form of system. Our country needs to perfect the existing legislation and promote the realization of legislative justice. We should correct the aim of legislation, carry forward the just value of law, insist on the democratization of legislation, unblock the channels of people's participation in legislation, advocate the openness of legislative procedure and guarantee the fair game of the subject of interest. Strengthen legislative review, do a good job in legal clean-up and record-keeping work.
