规范法学视野下的民间法研究

【摘要】：传统民间法研究常遭受种种批评,其根源多在于民间法并未明确自身的规范定位。民间法属于行为规范的范畴,但并不属于法律的规范范畴,因而从学理上说需要以"民间规范"来丰富"民间法"的概念内涵。这意味着民间法研究首先需要着重关注民间规范对于正式秩序的结构问题,这是民间法研究在法治语境下证成自身正当性与合理性的必然选择。民间法需要以"权利"为基本范畴展开研究,以期作为中国现代法治建设的助益资源。民间法的当下研究任务包括:重建民间规范的话语体系、构建民间规范的理论体系以及证成多元规范共治下的新型法治模式。
[Abstract]:The study of traditional folk law is often criticized, most of which lies in the fact that folk law does not clearly define its own normative position. Folk law belongs to the category of norms of conduct, but does not belong to the category of norms of law, so theoretically it is necessary to enrich the concept connotation of "folk law" with "folk norms". This means that the study of folk law first needs to pay attention to the structure of folk norms for the formal order, which is the inevitable choice for the study of folk law to prove its legitimacy and rationality in the context of the rule of law. Folk law needs to be studied with "rights" as the basic category in order to serve as a useful resource for the construction of modern rule of law in China. The current research tasks of folk law include: rebuilding the discourse system of folk norms, constructing the theoretical system of folk norms and proving a new model of rule of law under the co-rule of pluralistic norms.
