【摘要】：村庄的治安关系到村民的生产生活和权利,为村庄提供安全是国家治理能力现代化的重要面向。村庄的原子化,村民个体的崛起使家、家族、村落已经丧失了其对村庄秩序的大部分调控功能,作为派出所治安工作的支撑性的社会机制削弱、瓦解。在权利救济和服务型警务的主流话语之下,村庄的治安问题纷纷流向了派出所。派出所在资源有限、权力规训和治安压力的夹击之下,通过放弃自由裁量权、消极不作为、默许私力救济等形式合法的手段对流入的村庄治安问题进行趋向性的调处,进而让村庄达到派出所认为的可控状态。派出所的趋向性调处对村民的行为产生了影响,诱导村民根据治安问题的类型选择性的启动派出所的救济。而就派出所选择进行的调处案件而言,派出所也不能在案件的处理中完全占据主导的地位,问题的最终解决是具体的场域中各参与者利益、需求的平衡和妥协的结果。这一个过程也反映了法律的计划性、抽象性与村庄社会的复杂性之间的矛盾,显现了法律在乡村社会实施的困难。而对于被派出所排除在外的,与村民日常生活密切相关的治安问题,基于维护自身权益的需要,村民启动了私力救济。但是这种救济在乡村去政治化的背景和法治的主流话语之下,面临着维持不下去、合法性不足的问题,运行困难重重,村民的权利有得不到救济的危险。
[Abstract]:The security of the village relates to the production, life and rights of the villagers, and providing security for the village is an important aspect of the modernization of the national governance ability. The atomization of the village and the rise of the individual of the villager make the family and the family. The village has lost most of its regulation and control function to the order of the village. As the supporting social mechanism of police station security work, the social mechanism is weakened and disintegrated. Under the mainstream discourse of right relief and service policing. The security problems of the village flow to the police station one after another. The police station under the attack of limited resources, power discipline and public security pressure, by giving up the discretion, negative inaction. Acquiesced in the private relief and other legal means to the inflow of village security issues of the trend of mediation, so that the village to achieve the controllable state of the police station. The tendency of the police station has an impact on the behavior of the villagers, inducing villagers to selectively start the relief of the police station according to the type of public security problem. The police station can not completely occupy the dominant position in the handling of cases, the final solution of the problem is the specific interests of the participants in the field. The balance of demand and the result of compromise. This process also reflects the contradiction between the planning, abstraction and the complexity of the village society, and shows the difficulty of implementing the law in the rural society. For the police station excluded, and the villagers' daily life is closely related to the security issues, based on the need to maintain their own rights and interests. Villagers started private relief, but under the background of rural depoliticization and the mainstream discourse of the rule of law, the villagers are faced with the problem of lack of legitimacy, difficult to run. The villagers' rights are in danger of being denied redress.
