受家暴女性犯罪的实证分析

【摘要】：自从进入文明社会以来,女性是维系家庭和社会的重要纽带,在社会的和谐稳定发展中发挥了重要作用。然而,有家暴问题的家庭数量并没有随着社会进步而减少,家庭暴力不但严重威胁到已婚妇女的生命,也是受家暴女性犯罪的原因。目前我国学界对于家庭暴力引发的女性犯罪领域的研究多集中于理论层面,极少有系统的针对具体案件的统计分析,本文随机选取中国裁判文书网公布105起已结案的由家庭暴力引发的女性犯罪的真实案例,运用实证分析法,进行系统的分析、归纳和总结,发现女性被告人的年龄多处于中青年阶段、文化程度集中在高中学历以下、多为无业或务农、案发后均具有自首并如实供述等表现,表明此类犯罪区别于其他故意犯罪的特殊性,呈现出犯罪对象针对性较强、社会危害性较小的特征。对受家暴女性犯罪的现状和特点以及犯罪人的特点进行剖析,论述案例中女性由于家庭暴力而导致犯罪的各项具体表现。对于案件的定罪量刑存在量刑偏重的情况提出轻刑建议,同时针对受家暴女性犯罪的特殊性,提出具有针对性和可行性的量刑建议。
[Abstract]:Since entering civilized society, women have been an important link between family and society and have played an important role in the harmonious and stable development of society. However, the number of families with the problem of domestic violence has not decreased with the progress of society. Domestic violence is not only a serious threat to the lives of married women, but also a cause of crimes committed by women who are victims of domestic violence. At present, the research in the field of female crime caused by domestic violence in our country is mostly focused on the theoretical level. There are few systematic statistical analysis of specific cases, this paper randomly selected 105 closed cases of women crimes caused by domestic violence published by the China adjudicative documents Network, using empirical analysis, to carry out a systematic analysis. Summing up and summing up, it is found that the age of female defendants is mostly in the middle and young stage, the education level is concentrated under high school education, most of them are unemployed or working in agriculture, all of them have the performance of surrendering themselves and giving up truthfully after the crime. It shows that this kind of crime is different from other intentional crimes, showing the characteristics that the object of the crime is relatively strong and the social harmfulness is small. The present situation and characteristics of the female victims of domestic violence and the characteristics of the perpetrator are analyzed. This paper discusses the specific manifestations of crimes committed by women due to domestic violence, and puts forward some suggestions for light punishment in the case of conviction and sentencing, at the same time, aiming at the particularity of the crimes committed by women who are victims of domestic violence. Put forward the pertinence and feasibility of sentencing recommendations.
