伊斯兰教与犯罪控制

【摘要】： 社会总是需要某种程度的控制以实现社会稳定和预防犯罪,宗教与社会控制之间有着密切的关系。宗教能够成为犯罪的手段或者源头,也可以成为化解矛盾,减少犯罪的手段和方法。伊斯兰教是劝善戒恶的宗教,引导人们提高道德修养,化解仇怨,从而减少犯罪。伊斯兰教法直接规定了对犯罪的处罚。伊斯兰教创立不久即成为国教,成为伊斯兰国家社会生活的指导,上升到最高法律的地位,在历史上与伊斯兰国家政权互相支持,起到了稳定社会,减少犯罪的作用。近现代以来,随着伊斯兰国家的西方化和现代化,伊斯兰社会与西方国家的冲突和矛盾不断激化,回复伊斯兰传统让伊斯兰教重新成为伊斯兰国家社会生活的指导的思想成为一种主要的社会改革方案,原教旨主义也应运而生,恐怖主义作为实现其社会改革方案的手段而被频繁的运用,伊斯兰教与现代世俗国家之间的矛盾因而不断的被激化,伊斯兰与犯罪控制的关系更加的引人关注。在中国,伊斯兰教历史久远,中国也有大量的穆斯林。伊斯兰教不是中国的国教,伊斯兰教也没能成为中国主流的政治文化思想,中国历代封建政权特别是清政府与穆斯林及伊斯兰教之间有着矛盾和冲突。然而,伊斯兰教仍然是中国穆斯林的主要的生活指导,对中国民族团结和领土完整有着举足轻重的作用,对稳定社会,减少社会矛盾,控制犯罪有着重大的影响。近现代特别是改革开放以来,中国穆斯林逐渐的世俗化,现代化,宗教与政治分离,服务于中国的社会建设和发展,促进社会和谐,化解矛盾,控制犯罪。
[Abstract]:Society always needs some degree of control in order to achieve social stability and crime prevention. There is a close relationship between religion and social control. Religion can be a means or source of crime, but also a means to resolve conflicts and reduce crime. Islam is a religion that exhorts good from evil, leads people to improve their moral cultivation, defuses hatred and reduces crime. The Islamic Shariah provides direct penalties for crimes. Soon after the founding of Islam, it became the state religion and the guide of social life in Islamic countries. It rose to the status of supreme law, supported each other in history with the regime of Islamic countries, and played a role in stabilizing the society and reducing crime. Since modern times, with the westernization and modernization of Islamic countries, the conflicts and contradictions between Islamic society and western countries have been intensified. The return of Islamic tradition to the idea that Islam is once again the guiding factor in the social life of Islamic countries has become a major social reform programme, and fundamentalism has emerged as the times require. Terrorism is frequently used as a means to realize its social reform program, and the contradiction between Islam and modern secular state is constantly intensified. The relationship between Islam and crime control is more and more concerned. In China, Islam has a long history, China also has a large number of Muslims. Islam is not the state religion of China, and Islam has not become the mainstream political and cultural thought in China. There are contradictions and conflicts between Chinese feudal regimes, especially the Qing government and Muslims and Islam. However, Islam is still the main life guidance of Chinese Muslims, which plays an important role in Chinese national unity and territorial integrity, and has a significant impact on stabilizing society, reducing social contradictions and controlling crime. In modern times, especially since the reform and opening up, Chinese Muslims have gradually become secularized, modernized, separated from religion and politics, serving the social construction and development of China, promoting social harmony, resolving contradictions and controlling crime.
