流动人口犯罪与预防研究

【摘要】： 流动人口,是指离开常住户籍所在地、跨越一定的行政辖区,在异地滞留,暂时不返回的人员。具体分为以务工、经商为特征的社会就业型流动人口；以探亲、旅游、度假为特征的社会交往型流动人口；以开会、出差、商贸活动为特征的社会公务型流动人口；也包括以流动为掩护手段、以实施犯罪和逃避打击为目的的流窜犯罪人口。人口的流动使得城市获得了大量廉价劳动力,为当地经济发展起到了一定的积极作用,但另一方面,人口流动也给城市的市政管理、交通运输、社会就业、市容卫生和环境造成了巨大压力,流动人口的违法犯罪活动的日渐猖獗也是影响社会治安也是不争的事实。流动人口犯罪率高、恶性程度大、危害严重,扩区域流窜等,给公安机关侦查破案带来了极大的困难。如何加强流动人口管理,积极预防其违法犯罪已经是一个亟待解决的问题。流动人口犯罪在现阶段主要表现为以下几个特点：一是类型集中化,主要是集中在侵财型犯罪和侵害人身权的犯罪；二是动机单一化,大多是为了满足自己贪婪和低级的需要而实施的犯罪；三是表现出低龄化的趋势,在流动人口犯罪中,青少年占有很大的比重；四是表现为犯罪规模团伙化,由于流动人口之间存在血缘、地缘等关系,使得他们在犯罪时容易形成有组织的集团犯罪。流动人口犯罪的主要原因是社会因素和个人因素综合导致的结果,具体来说,主要是由于社会制度和政策等相关规定的不合理因素、文化价值观的冲突以及流动人口自身素质和意识等原因造成的。针对这些原因,应该从缓和社会矛盾、完善相关制度和政策、改善管理、转变观念和加强对流动人口的培训和教育等方面着手解决。控制和预防流动人口犯罪对于搞好社会环境、维护社会秩序、促进社会和谐有着巨大的意义。
[Abstract]:Floating population refers to those who leave the permanent residence area, cross a certain administrative area, stay in a different place, and do not return temporarily. It can be divided into social employment floating population characterized by labor and business, social intercourse floating population characterized by visiting relatives, traveling and vacationing, social official floating population characterized by meeting, business and business activities. It also includes mobile criminals who use mobility as a cover for crime and evasion. Population mobility makes cities get a lot of cheap labor, which plays a positive role in the development of local economy. On the other hand, population mobility also gives urban administration, transportation and social employment. City appearance hygiene and environment have caused great pressure, and it is also an indisputable fact that the illegal and criminal activities of floating population are rampant day by day. The crime rate of floating population is high, the degree of malignancy is great, the harm is serious, and so on, which brings great difficulties to public security organs to investigate and solve cases. How to strengthen the management of floating population and actively prevent its illegal crime has become a problem to be solved. At the present stage, the crimes committed by the floating population are mainly characterized by the following characteristics: first, centralization of types, mainly concentrated in crimes of invading property and infringing upon personal rights; second, single motivation. Most crimes are committed in order to meet their own greed and low-level needs. Third, they show a trend of younger age. In the floating population crime, young people account for a large proportion. Fourth, the crime is characterized by gang crime on a large scale. Because of the relationship between floating population, such as blood, geography and so on, it is easy for them to form organized group crime when they commit crimes. The main reason for floating population crime is the result of the combination of social and personal factors. Specifically, it is mainly due to unreasonable factors in the social system and policies and other relevant provisions. The conflict of cultural values and the floating population's own quality and consciousness. In view of these reasons, we should solve these problems from the aspects of easing social contradictions, perfecting relevant systems and policies, improving management, changing ideas and strengthening the training and education of floating population. It is of great significance to control and prevent the crime of floating population for improving social environment, maintaining social order and promoting social harmony.
