制度犯罪学初论——科学与公共政策相结盟

【摘要】：本文力图开辟一个新的犯罪学研究领域——"制度犯罪学"(institutional criminology)。传统犯罪学理论以纯实证的态度和方法对个体因素或社会结构因素与犯罪现象之间的相关性进行研究,制度犯罪学则是科学与权力或科学知识与权力知识之间的结盟,以科学的态度和方法,再加上政策学、政治学的眼光,研究在既定社会条件下公共政策与犯罪问题之间的相关性。制度犯罪学坚持认为,犯罪问题是一个公共政策问题。基于这一认识,制度犯罪学关注以下具体问题:政府在解决犯罪问题中的作为如何?在解决犯罪问题过程中政府应当做什么(should to do)、能够做什么(can do)、打算或不打算做什么(choose to do or choose not to do)、已经做什么(have done)。制度犯罪学研究使犯罪学由一门纯粹的实证科学走向一门具有政治献策功能的决策科学。
[Abstract]:This paper tries to open up a new research field of criminology-"Institutional Criminology" (institutional criminology). The traditional criminology theory studies the relationship between individual factor or social structure factor and criminal phenomenon with a purely positive attitude and method, while institutional criminology is an alliance between science and power or scientific knowledge and power knowledge. The relationship between public policy and crime under the given social conditions is studied in a scientific attitude and method, in addition to the perspective of policy science and political science. Institutional criminology insists that crime is a public policy issue. Based on this understanding, institutional criminology is concerned with the following specific issues: how does the government act in solving the crime problem? What should the Government do in the process of solving the Crime problem? what (should to do), can do? what (can do), intends or does not intend to do? what (have done). Has been done by (choose to do or choose not to do),? The study of institutional criminology leads criminology from a pure positive science to a policy science with the function of political advice.
