【摘要】： 本文通过分析法律简明意义解释规则和法律翻译实践的联系,论证了法律简明意义解释规则指导下的法律翻译策略能实现原文意义的忠实传递并确保法律翻译效力的实现。作为法律解释规则之一的简明意义解释规则赋予法律词汇平实、普通和合理的意义以达到传递立法者真实目的和保留原文法律效力的目的。在法律简明意义解释规则的指导下,法律翻译者能准确理解原文从而达到翻译的忠实性。同时,使法律翻译者在翻译过程中获得认知上的补充并确保译文具有与原文相等的法律效力。译者可以在法律简明意义解释规则的指导下灵活运用翻译策略。为实现原文意义的忠实传递,直译或语义翻译适用于法律翻译。为提高译文的可读性并使译文意义更完整,实现对译入语的法律体系认知补充,异化适用于法律翻译。为保留原文的法律效力,功能对等和交际翻译适用于法律翻译。功能对等和交际翻译在法律简明意义解释规则的指导下能找到原文信息最自然的对应词语,即获得对应的效力。本文结合法学基本理论并将法律解释规则运用于法律翻译,尽力尝试语言学来理论与法学基本的衔接,具有一定的理论创新,在实现法律简明意义解释规则指导下灵活运用法律理论、解释学原理,力求法律翻译策略的突破,最终在译文忠实传递原文意义的前提下,更大程度上保留与法律翻译文本所应具备的法律效力。
[Abstract]:This paper analyzes the relationship between the rules of interpretation of the concise meaning of law and the practice of legal translation. It is demonstrated that the legal translation strategy under the guidance of the rules of concise meaning interpretation of law can realize the faithful transmission of the meaning of the original text and ensure the realization of the effect of legal translation. As one of the rules of legal interpretation, the rules of interpretation of concise meaning confer the law on the interpretation of meaning. The word of law is plain. Ordinary and reasonable meaning in order to achieve the purpose of transmitting the true purpose of the legislator and retaining the legal effect of the original text, under the guidance of the rules of interpretation of the concise meaning of the law. Legal translators can accurately understand the source text to achieve the fidelity of translation, at the same time, the legal translator can obtain cognitive supplement in the process of translation and ensure that the legal translation has the same legal effect as the original text. The translator can use translation strategies flexibly under the guidance of the rules of interpretation of the meaning of the law in order to achieve the faithful transmission of the meaning of the original text. Literal translation or semantic translation is applicable to legal translation. In order to improve the readability of the translation and make the meaning of the translation more complete, the cognitive supplement of the legal system of the target language can be realized. Dissimilation is applicable to legal translation in order to preserve the legal effect of the original text. Functional equivalence and communicative translation are applicable to legal translation. Functional equivalence and communicative translation can find the most natural corresponding words of the original information under the guidance of the rules of interpretation of the concise meaning of the law, that is, to obtain the corresponding effect. Combining the basic theory of law and applying the rules of legal interpretation to the translation of law, this paper tries to try its best to link the theory of linguistics with the basic theory of law, and has a certain theoretical innovation. Under the guidance of the rules of concise interpretation of law, the author makes flexible use of legal theory and hermeneutics, strives for a breakthrough in the strategy of legal translation, and finally, on the premise of faithful transmission of the meaning of the original text in the translated text. To a greater extent, the legal effect of legal translation should be preserved.
