【摘要】：任何立法行为都追求一定的价值,都受价值选择的支配,都包含着相应的价值取向。环境立法的价值取向是环境法创制时就应首先考虑的问题。研究环境立法的价值取向首先要从研究环境法的价值入手。环境立法的价值取向直接来源于环境法的价值,因此,环境法价值体系的构建状况,直接影响环境立法中价值取向的能否选择和选择质量。环境法价值体系的构建需要先进的环境伦理指导,在对各种伦理价值观的比较分析中,我们得到这样的结论：无论“人类中心主义”还是“非人类中心主义”都有自身无法克服的缺陷,这种不足直接导致了实践的困难。而可持续发展观作为一种新型的发展理念,突破了传统环境伦理价值观争辩的束缚,更加注重对现实问题的解决,具有很强的实践性。所以,我们不仅将可持续发展观作为我国环境法价值的伦理基础,同时将其作为环境法价值体系构建的指导思想。研究价值就不能忽略对价值冲突的研究。价值冲突问题是环境法价值研究的重要部分。对价值冲突的理解程度的高低,价值冲突的解决效果的好坏,都直接反应了我们所构建的价值体系是否稳定、和谐和统一。对环境法价值冲突解决方式的探索,也可以为环境立法价值取向之间的冲突的有效解决提供参考。我国的环境立法价值取向既不能脱离传统环境伦理而凭空臆造,更不能是“拿来主义”。中国的环境立法价值取向的确定应立足与本国的现实需要,应以解决亟需的问题为首要任务,因此,本文将我国的环境立法价值取向划分为：最高价值取向和基本价值取向。以最高立法价值取向为宏观指导,以基本价值取向来解决不同环境领域的环境立法问题,使我国环境立法既做到同一,即为实现人与人、人与自然的和谐,又有不同,即根据不同环境领域的不同调整对象和立法目的具体问题具体分析。
[Abstract]:Any legislative act pursues a certain value and is subject to the choice of value. The value orientation of environmental legislation is the first consideration in the creation of environmental law. To study the value orientation of environmental legislation, we should start with the value of environmental law. The value orientation comes directly from the value of environmental law. Therefore, the construction of value system of environmental law directly affects the choice and quality of value orientation in environmental legislation. The construction of the value system of environmental law needs advanced environmental ethics guidance, in the comparative analysis of various ethical values. We have come to the conclusion that whether "anthropocentrism" or "non-anthropocentrism" has its own insuperable defects. This deficiency directly leads to practical difficulties. As a new development concept, the sustainable development concept breaks through the shackles of traditional environmental ethics and values, and pays more attention to the solution of practical problems. Therefore, we not only regard the concept of sustainable development as the ethical basis of the value of environmental law in our country, but also regard it as the guiding ideology of the construction of the value system of environmental law. The study of value conflict is an important part of the value study of environmental law. The degree of understanding of value conflict and the resolution of value conflict are good or bad. It directly reflects whether the value system we have built is stable, harmonious and unified, and explores how to resolve the value conflict of environmental law. It can also provide reference for the effective solution of the conflict between the value orientation of environmental legislation. The value orientation of environmental legislation in our country can not be conjectured from the traditional environmental ethics, nor can it be "making use of it". The determination of the value orientation of environmental legislation in China should be based on the actual needs of our country. Therefore, this paper divides the value orientation of our country's environmental legislation into the highest value orientation and the basic value orientation, and takes the highest legislative value orientation as the macroscopic guidance. With the basic value orientation to solve the environmental legislation problems in different environmental fields, so that our environmental legislation not only achieve the same, that is to achieve the harmony between man and man, man and nature, but also different. Namely according to the different environment domain different adjustment object and the legislation goal concrete question concrete analysis.
