法律文化视野下的宋慈《洗冤集录》

【摘要】：法律文化作为文化重要的组成部分，其中法律思想是“内核”，法律制度是“外壳”，二者均被打上了时代的烙印。本文通过探究宋慈及其《洗冤集录》产生的时代背景、理论渊源，试图对宋慈《洗冤集录》的“内核”即法律思想进行深入研究，进而揭示“外壳”所赖以根植的中国传统司法文化的丰富内涵，通过考察《洗冤集录》对后世司法检验制度、检验方法和审判等的影响，为我国现代法治建设提供历史的理论借鉴。论文从五个部分展开讨论。第一部分，通过对宋慈生平以及《洗冤集录》书名、写作意图等的探讨，简要概述宋慈及《洗冤集录》。第二部分，从法律文化学的视角，寻根溯源，深入探究宋慈《洗冤集录》法律思想产生的社会历史背景和思想渊源，通过对南宋时期社会历史背景的总结，以概述其思想形成的历史基础、理论渊源和实践渊源。第三部分，系统的从思想、制度、技术和司法四个方面对《洗冤集录》展开研究，注重将理论上升到制度层面，指导司法实践，总结其中的有益经验。第四部分，通过评价《洗冤集录》法律思想的价值，总结其进步性，指出其局限性。第五部分，简要概述《洗冤集录》法律思想对现代法治建设的启示，，揭示《洗冤集录》法律思想的法律文化学意义。
[Abstract]:As an important part of culture, legal culture is the core of legal thought and the outer shell of legal system. Both of them have been branded with the brand of the times. By exploring the background and theoretical origin of the generation of Song ci and his Collection of Wash grievances, this paper attempts to make an in-depth study of the "core" of Song ci's Collection of Wash grievances, that is, the legal thought. Then it reveals the rich connotation of the Chinese traditional judicial culture on which "shell" is rooted, and through the investigation of the influence of "the collection of cleansing grievances" on the system of judicial inspection, the method of examination and the trial of later generations. To provide historical reference for the construction of modern rule of law in China. The paper is discussed in five parts. The first part, through the discussion of Song ci's life, the title of the book, the intention of writing and so on, gives a brief overview of Song ci and the Collection of the Wash of grievances. The second part, from the perspective of legal culturology, to find the root of Song ci, deeply explore the social and historical background and ideological origin of the legal thought, through the summary of the social and historical background of the Southern Song Dynasty. In order to outline its ideological formation of the historical basis, theoretical and practical origin. In the third part, the author makes a systematic study on the collection of grievances from four aspects of thought, institution, technology and judicature, focusing on raising the theory to the level of system, guiding the judicial practice and summing up the beneficial experience among them. In the 4th part, by evaluating the value of the legal thought, the author summarizes its progress and points out its limitation. In the 5th part, the author briefly summarizes the enlightenment of the legal thought on the construction of the modern rule of law, and reveals the legal cultural significance of the legal thought.
