论法的安定性及其制度安排

【摘要】： 法的安定性是法治国家原则核心内容之一,完善的法治国家具备一系列维护法的安定的原则。法的安定性使整个法律制度及其运行的状况和结果能够保持某种惯常状态,最终能实现社会有序的属性。本文对法的安定状态进行研究,目的是通过历史与规范的分析来回答法的安定背景下法的存在、实施与改良等问题,为现有或将来民主制度下的国家进行符合国家宪法的法律制度的设计提供参考。笔者希望制度设计者在规划或改革法律制度时,能够充分考虑法的安定的要求,避免和防止陷入困境。
[Abstract]:The stability of law is one of the core contents of the principle of a country ruled by law. A perfect country under the rule of law has a series of principles of maintaining the stability of law. The stability of law enables the whole legal system and its operating conditions and results to maintain a certain normal state. The purpose of this paper is to answer the questions of the existence, implementation and improvement of law in the context of law stability through the analysis of history and norms. This paper provides a reference for the design of a legal system in accordance with the Constitution of a country under the present or future democratic system. The author hopes that the designer of the system can take full account of the requirements of the stability of the law when planning or reforming the legal system. Avoid and prevent getting into trouble.
