【摘要】：谢觉哉同志是一名伟大的无产阶级革命家、杰出的社会活动家、法学界的先导、人民司法制度的奠基者,也是坚定的马克思主义者。谢觉哉把其一生都奉献给了党和人民,在谢老的革命生涯中,有大部分时间都在从事党的法制工作,在这期间,形成了一系列丰富的法律思想,为我国的法制建设作出了重大的贡献。时至今日,谢觉哉法律思想中蕴含的一些经典理论,对当前的中国社会仍然有巨大的现实指导意义。本文对谢觉哉在延安时期至建国初期的法律思想作了较为深入的研究。本文前有“绪论”后有“结束语”,中间正文共分三个部分：第一部分：谢觉哉法律思想形成的历史背景。这一部分是本文研究的逻辑起点。论述了两个方面：谢觉哉的革命经历和政治实践；马克思主义、列宁法律思想对谢觉哉法律思想的影响。指出：(一)谢觉哉由传统的秀才逐步发展成为新民主主义革命的先驱者。而在边区从事多项领导工作特别是法制工作的经历,使其能够在法律方面总结出独具特色的科学见解。(二)延安时期至建国初期,谢觉哉对马克思主义经典著作进行了精细的研读。马克思主义理论为谢觉哉的法律思想提供了科学的分析方法；列宁的法制思想是丰富而深刻的,在理论方面对中国共产党领导的新民主主义革命起指导作用,对谢觉哉等中国共产党人探索社会主义新法制产生了直接而深刻的影响。第二部分：谢觉哉法律思想的主要内容。这一部分是本文研究的重点。从立法思想、司法思想和守法思想三个方面作了探讨。谢觉哉的立法思想包含了三方面的内容：实事求是,制定适合中国国情的立法原则；走群众路线,发扬人民民主的立法方针；法律原则性和灵活性相结合。其司法思想包含了四个方面的内容：重视人民调解工作；主张审判与调解相结合；树立新的刑罚观,主张教育劳动改造罪犯；重调查,重证据,坚持严格司法。其守法思想包含了三个方面的内容：坚持依法办事；加强普法工作；培养法律人才。第三部分：谢觉哉法律思想的理论价值和现实指导意义。这一部分是本文的落脚点。首先,指出谢觉哉法律思想的理论价值,即其极大地丰富了马克思主义中国化法律理论的宝库。如：谢觉哉“依法办事”的思想充实了马克思主义中国化第一次理论飞跃——毛泽东思想中关于政策和策略的理论；实事求是,一切从实际出发的司法工作态度是对毛泽东政策理论的继承和发扬,等等。接着,着重论述了谢觉哉法律思想的现实指导意义：谢觉哉的法律思想在时代发展的今天,仍有很强的实践指导性。我们对谢觉哉法律思想的学习主要从以下几方面进行：(一)坚持一脉相承又与时俱进的理论品格。理论源于实际,一切从实际出发,针对新问题提出新方案；(二)谢觉哉的法律思想是对法律理论与法治实践的融合；(三)坚持学习“老一辈”的理论勇气,开拓“新境界”。
[Abstract]:Comrade Xie Juezai is a great proletarian revolutionary, an outstanding social activist, leading scholars, founder of the people's judicial system, but also a firm the Marx doctrine. Thanks as devoted his life to the party and the people, to thank old revolutionary career, most of the time are engaged in legal work the party, in this period, formed a series of rich legal thoughts, has made great contribution to the legal construction of our country. Today, some classical theories contained in legal thoughts as Xie, the current China society still have great practical significance.
This paper makes a deep research on Xie Juezai's legal thoughts during the period from Yanan to the early stage of the founding of PRC. Before the introduction, there are concluding remarks. The middle text is divided into three parts.
The first part: the historical background of Xie Juezai's legal thoughts. This part is the logical starting point of this paper. It discusses two aspects: Xie Juezai's revolutionary experience and political practice; the Marx doctrine and influence of Lenin's Legal Thought on Xie as legal thought. Xie Juezai pointed out: (a) from the traditional scholar gradually become a pioneer of new development democratic revolution. And in the border region engaged in a number of leading work especially legal work experience, so that it can be summed up the unique scientific insights in the law. (two) Yanan period to the founding of new China, Xie Juezai had careful reading of Marx's classic works. Marx's theory provides a scientific method of analysis for the legal thought of Xie Juezai; Lenin's legal thought is rich and profound, in the theory of new democratic revolution under the leadership of the Communist Party of China refers to the play The guiding effect has a direct and profound influence on the Chinese Communists such as Xie Juezai and other Chinese Communists to explore the new socialist legal system.
The second part: the main content of Xie Juezai's legal thoughts. This part is the focus of this paper. From the three aspects of legislative idea, the judicial idea and law-abiding thought are discussed. Xie as legislative thought includes three aspects: seeking truth from facts, formulate legislative principles for Chinese conditions; follow the mass line, promote the people's democracy the principle of legislation; legal combination of principle and flexibility. The judicial thought includes four aspects: the importance of the work of people's mediation; advocate the combination of conciliation and trial; set up the new concept of penalty, labor advocate the education reform criminals; investigation, evidence, adhere to strict justice. The law thought contains three aspects: adhere to act according to law; strengthen the legal work; the legal talent training.
The third part: the theoretical value of Xie Juezai's legal thoughts and practical significance. This part is the foothold of this paper. Firstly, points out that the theoretical value as Xie's legal thoughts, which greatly enriches the legal theory of the Marx doctrine Chinese. Such as: Xie Juezai "law" thought enriches the first theoretical leap in Marx "Chinese -- Mao Zedong thought of policy and strategy theory; seeking truth from facts, everything from the reality of the judicial work attitude and carry, inheritance of Mao Zedong policy theory and so on.
Then, focuses on the legal thought of Xie Juezai's practical significance: the legal thoughts of Xie Juezai in the times of today, there is still a strong practical guidance. We learn to thank as the legal thought is mainly from the following aspects: (a) adhere to the theoretical character of line and keep pace with the times. The theory comes from practice, all from a practical point of view, the new problems in the new scheme; (two) the legal thought of Xie Juezai is the integration of legal theory and practice of the rule of law; (three) adhere to the "learning theory, the courage" to open up a new realm.
