和谐社会的法治思考

【摘要】： 依法治国,建设社会主义法治国家与构建和谐社会之间有没有必然联系,二者在创建过程中能不能相互促进,协调发展,是一个需要我们认真对待和思考的问题。任何社会都离不开法律以及其他社会规范的整合作用,现代和谐社会更必须是法律制度完善、法治运行良好的法治社会。法律作为最强有力、最主要的社会调整规范,在和谐社会的构建中发挥着尤为关键的功能和作用。和谐社会的建设离不开法治,法治是构建和谐社会的基石。同时,法治也是在社会中产生和发展起来的,和谐社会的建设也推动了法治的发展。本文对法治在和谐社会建设中的作用,和谐社会对法治的推动和发展进行了分析,并揭示了二者之间的相互关系。本文除导论和结语外共分五个部分: 第一部分:和谐社会思想渊源探析在这一部分里,通过的中外传统社会中(包括马克思主义)的和谐思想,和谐社会思想,以及历史上曾经存在过的人们较为理想的社会状态的梳理和分析,对中外传统文化的“和谐”及“和谐社会”的思想、形态进行了分析和总结,并指出当代中国共产党人所提出的和谐社会的理论,是具有深厚历史渊源的,是人类几千年来追求幸福、美好生活的继续。第二部分:当代中国社会主义和谐社会解读在这一部分里,通过对中国共产党人探索和谐社会的历程,社会主义和谐社会的目标任务、特征、内涵以及所具有的现实、历史意义的分析,揭示了当代中国社会主义和谐社会理论,是在充分吸收和借鉴人类社会优秀文明成果基础上,并结合当前中国经济、社会发展的现实情况所提出来的。它是切合中国目前实际,并且能够实现的一个战略目标。第三部分:法治及其相关因素分析在这一部分里,通过对中外法治思想、对法治的内涵外部特征以及社会主义法治的探讨,指出了法治是目前人类所找到的一条治国理政,实现社会生活健康有序发展的最好途径。只有切实加强法治建设,才能确保和谐社会目标的实现。第四部分:法治与和谐社会的关系在这一部分里,通过分析指出法治是和谐社会的基石,是实现和谐社会各项目标的主要保障,和谐社会的建设离不开法治功能的发挥。同时指出和谐社会的提出丰富了法治的内涵,拓宽了法治的调整范围。和谐社会发达的生产力、人们较高的科学文化水平,又推动和促进了法治向更高水平前进。第五部分:通向和谐社会的法治路径在这一部分里,笔者认为推动和谐社会目标的实现,需要对现在社会中存在的阻碍这一目标实现的体制机制进行相应的改革,消除前进中的障碍。具体来讲有,通过完善立法、建立和谐立法体系,通过加强司法建设、实现公正司法,以及转变政府职能、建立服务型政府等,并对这些问题进行了分析和探讨。
[Abstract]:Is there an inevitable connection between governing the country according to law, building a socialist country ruled by law and building a harmonious society, and whether the two can promote each other and develop in a coordinated manner in the course of their establishment? Any society can not do without the integration of the law and other social norms, the modern harmonious society must be a perfect legal system, As the most powerful and the most important social adjustment norm, the law plays a particularly critical role in the construction of a harmonious society, and the construction of a harmonious society cannot be separated from the rule of law. The rule of law is the cornerstone of building a harmonious society. At the same time, the rule of law is produced and developed in the society, and the construction of a harmonious society also promotes the development of the rule of law. The harmonious society analyzes the promotion and development of the rule of law, and reveals the relationship between the two. In addition to the introduction and conclusion, this paper is divided into five parts:. The first part: an Analysis of the ideological Origin of a harmonious Society. In this part, through the Chinese and foreign traditional society (including Marxism) of the harmonious thought, harmonious society thought, as well as the history of the existence of people's more ideal social status combing and analysis, This paper analyzes and summarizes the thought and form of "harmony" and "harmonious society" of Chinese and foreign traditional culture, and points out that the theory of harmonious society put forward by the contemporary Chinese Communists has profound historical origin. It is the continuation of the pursuit of happiness and good life for thousands of years. Part two: interpretation of Contemporary Socialist harmonious Society in China. In this part, through the analysis of the course of exploring the harmonious society, the target task, the characteristics, the connotation and the realistic and historical significance of the socialist harmonious society, It reveals that the theory of harmonious socialist society in contemporary China is put forward on the basis of fully absorbing and drawing lessons from the outstanding achievements of civilization in human society, and combining with the current reality of China's economic and social development. And can achieve a strategic goal. Part III: analysis of the Rule of Law and its related factors. In this part, the author points out that the rule of law is a rule of government found by human beings, through the discussion of the thought of rule of law at home and abroad, the external characteristics of the connotation of rule of law and the socialist rule of law. The best way to realize the healthy and orderly development of social life is to strengthen the construction of the rule of law in order to ensure the realization of the goal of a harmonious society. Part 4th: the relationship between Rule of Law and harmonious Society. In this part, it is pointed out through analysis that the rule of law is the cornerstone of a harmonious society and the main guarantee to achieve the objectives of a harmonious society. The construction of harmonious society can not be separated from the exertion of the function of rule by law. At the same time, it points out that the proposal of harmonious society enriches the connotation of rule of law and broadens the adjustment scope of rule of law, the developed productive forces of harmonious society and the higher scientific and cultural level of people. It has also promoted and promoted the rule of law to a higher level. Part 5th: the path of Rule of Law to a harmonious Society. In this part, the author thinks that to promote the realization of the goal of a harmonious society, we need to reform the existing institutional mechanism that hinders the realization of this goal in the present society, and eliminate the obstacles in the progress. Specifically, there are, Through perfecting legislation, establishing harmonious legislative system, strengthening judicial construction, realizing just judicature, transforming government function and establishing service-oriented government, this paper analyzes and discusses these problems.
