和谐视角下的“亲亲相隐”

【摘要】： 本文对“亲亲相隐”法律制度的形成及变迁进行考察,兼及一些西方国家相关的法律该制度。从中国古代的农业经济,血统亲缘的社会,大一统的国家等因素,分析亲亲相隐制度产生的历史条件,说明该制度的普适性及其所具有的和谐功能。 从中国法律传统中的和谐思想作为视角,分析亲亲相隐制度对家庭、农业经济、社会和国家的独特作用。最后从建设和谐社会出发,分析亲亲相隐制度遭批判、被废除的原因及后果,进而探讨亲亲相隐制度回归的可能性,为构建和谐社会提供借鉴。
[Abstract]:This paper examines the formation and changes of the legal system of "close relatives and hidden relatives", as well as the relevant laws of some western countries. From the agricultural economy of ancient China, the society of lineage and kinship, and the unifying country, and so on, the paper makes an investigation of the formation and changes of the legal system of "kin to one another". This paper analyzes the historical conditions of the system of kinship and concealment, and explains the universality of the system and its harmonious function. From the perspective of harmonious thought in Chinese legal tradition, this paper analyzes the unique role of the system of closeness between relatives and relatives on family, agricultural economy, society and country. Finally, from the point of view of building a harmonious society, this paper analyzes the critique of the system of closeness between relatives and relatives. The reasons and consequences of the abolition, and then explore the possibility of the return of the implicit system of relatives and relatives, for the construction of a harmonious society.
