【摘要】：当今中国已经是一个被公认为经济平稳快速发展、社会事业全面进步、综合国力明显提升的大国和强国!特别是改革开放以来,党带领全国各族人民紧抓机遇、拼搏进取、大胆创新,取得了令世人感叹的惊人业绩和辉煌成就,赢得了世界人民的热切关注。但在取得成绩的同时我们也必须承认,我国还在不同领域仍然或多或少存在着一些不足和问题,社会主义还未真正实现依法治国就是其一。而且,当前我国法治建设中存在大量亟需解决的问题,譬如当前引起人民强烈积愤的重庆文强案就给了我们当头一棒,它让我们深刻地认识到了国家法律工作人员任意践踏法律从而令法律蒙羞的这一严峻形势,这一现象不仅极大地损害了我国法治在人民心中的公信力,同时也严重地阻碍了法治化进程。因此,我们必须要在认真总结中国过去法治建设取得的成绩与经验的基础上,及时找出中国现时法治建设中存在的不足和根源所在,从而有针对性地探讨和创新更加行之有效的解决问题的方法,为我国建设社会主义法治国家出谋划策。科学发展观是以人为本、全面、协调、可持续的发展观,对于中国社会主义现代化法治的建设具有重大的指导意义。它所蕴含的科学内容和时代精神丰富和充实了法的基本价值,是建设社会主义法治国家的根本行动指南。社会主义法治建设,无论是作为一项事业,还是作为一项工作,都必须坚持以科学发展观为指导,要保证法治理念、立法、执法、司法和法律监督都要与科学发展观相适应,只有坚持以科学发展观为根本指导原则,即坚持以科学发展观统领社会主义法治建设,才能保证社会主义法治建设健康、科学化地发展。对科学发展观和法治社会建设的研究已经成为学术界的热点问题,许多学者从各个角度对二者进行了深入研究,取得了丰厚的学术成果。本文通过对大量相关文献、著作进行系统的梳理和归纳,结合我国实际情况,从科学发展观的视角出发,着重研究和思考如何从科学发展观的角度出发去建设法治社会、创建法治文明,在揭示科学发展观重大理论意义以及当前我国法治现状的基础上,就推进我国法治建设科学化发展提出了一点设想和建议。本文除绪论和结语外,共分为三部分。第一部分是科学发展观及其对法治建设的指导意义。首先对科学发展观的基本理论进行了概述,分别介绍了科学发展观的基本概念、科学发展观的提出背景、科学发展观的理论特性以及科学发展观的方法论意义。其次对科学发展观的基本内涵和精髓做了介绍,主要内容是发展是科学发展观的第一要义；以人为本是科学发展观的核心；全面协调可持续是科学发展观的基本要求；统筹兼顾是科学发展观的根本方法。最后是对科学发展观对我国法治建设指导意义的阐述,主要是从科学发展观引导我国在法治建设中树立社会主义法治理念观、树立统筹兼顾的科学立法观、树立依法执法的科学执法观、树立公正司法的科学司法观、树立科学的法律监督观这五方面的指导意义来阐述的。第二部分是科学发展观视角下我国法治现状的分析。首先,这部分内容介绍了当前我国法治建设者的法律理念存在的问题及原因,从传统和现实两个方面进行了原因剖析。其次,从法治实践中的各环节入手,以科学发展观为视角审视我国当前立法、执法、司法、法律监督中存在的问题及其原因,从整体对我国的法治现状做一个全面的分析。第三部分是从法治理念、立法、执法、司法、法律监督五方面介绍了推进法治建设科学发展的构想。首先在社会主义法治理念方面,推进社会主义法治理念科学发展主要是构建维护法律权威的法治理念、尊重和保障人权的法律理念和维护公平正义的法律理念；其次在立法方面,推进立法工作科学发展主要是建立健全立法创新机制、坚持以人为本立法为民的立法精神、实现立法与发展有机统一以及提高构建和谐社会的能力这四个方面进行了构想；在执法方面,主要是通过构建公正执法、严格执法、主动执法、高效执法来实现执法的科学化发展目标；在司法方面,主要是通过落实以人为本精神、统筹兼顾各方利益、全面提升司法公信力、实现全面协调可持续发展来实现司法科学发展；最后在法律监督方面,要通过全面加强法律监督、切实维护人民利益、服务大局为根本来实现法律监督在法治建设中的科学发展。
[Abstract]:Since the reform and opening - up , the Communist Party of China has led the people of all ethnic groups in the country to seize the opportunity , struggle to advance and innovate , and has won the world ' s impressive achievements and achievements .

The scientific development view is a human - oriented , comprehensive , coordinated and sustainable development view , and has great guiding significance for the construction of the socialist modernization rule of law in China . The scientific content and the spirit of the times enrich and enrich the basic value of the law . It is the fundamental guiding principle for the construction of the socialist country of law .

The research on the scientific development view and the construction of the rule of law society has become a hot topic in the academic circle , and many scholars have made a deep study on the two from various angles , and made rich academic achievements . From the perspective of scientific development view , this paper focuses on the research and reflection on how to construct the rule of law society from the view of the scientific development view , to create the rule of law civilization , and to put forward some ideas and suggestions on the scientific development of the construction of the rule of law in our country .

This paper is divided into three parts except the introduction and the conclusion .

The first part is the scientific concept of development and its guiding significance to the construction of the rule of law . Firstly , the basic theory of the scientific development view is summarized , the background of the scientific development view , the theoretical characteristics of the scientific development view and the methodological significance of the scientific development view are introduced . Secondly , the basic connotation and essence of the scientific development view are introduced .
People - oriented is the core of the scientific development view ;
The comprehensive coordination can be the basic requirement of the scientific development view ;
At last , the paper expounds the guiding significance of the scientific development view on the construction of the rule of law in our country . It is mainly from the scientific development view to guide our country to set up the concept of socialist rule of law in the construction of the rule of law , establish the scientific legislative concept , establish the scientific law enforcement view of law enforcement , establish the scientific judicial view of the public justice , and establish the scientific legal supervision view .

The second part is the analysis of the present situation of the rule of law in our country from the view of scientific development . Firstly , this part introduces the existing problems and causes of the legal concept of rule - of - law builder in our country .

The third part introduces the idea of promoting the scientific development of the construction of the rule of law from five aspects of the concept of rule of law , legislation , law enforcement , judicial and legal supervision .
Secondly , in the aspect of legislation , the scientific development of the legislative work is mainly to establish and perfect the legislative innovation mechanism , adhere to the legislation spirit of the people - oriented legislation , realize the organic unification of legislation and development and improve the ability to construct a harmonious society .
In the field of law enforcement , the objective of scientific development of law enforcement is achieved through the construction of public right law enforcement , strict law enforcement , active law enforcement and efficient law enforcement ;
In the administration of justice , it is mainly through the implementation of the human - oriented spirit , the unity of the interests of all sides , full promotion of the judicial credibility , the realization of comprehensive and coordinated sustainable development to realize the development of the judicial science ;
Finally , in the aspect of legal supervision , we should strengthen the supervision of the law , safeguard the interests of the people , and realize the scientific development of the legal supervision in the construction of the rule of law at all .
