哈尔滨解放区司法建设考察

【摘要】： 1946年4月民主联军解放哈尔滨后,哈尔滨成为了全国第一个获得解放的大城市,自此,哈尔滨解放区民主政权彻底废除了“领事裁判权”,确立了人民当家作主的司法主权,并在司法实践过程中逐步形成了具有“城市”特色的司法体系、诉讼与审判、狱政与调解制度。哈尔滨解放区的司法建设,是中国共产党践行城市司法建设的开端,为维护治安、巩固民主政权、保障经济发展,支援解放战争方面做出了突出贡献,是新中国司法建设历程中的重要环节。但是由于受到当时战争环境的制约以及民主政权管理大城市经验的缺乏,司法建设过程中也不乏失败的教训。研究哈尔滨解放区司法建设的经验与教训,可以使我们以史为鉴,革除旧弊,在当前司法改革的进程中少走弯路,在保持中国特色的前提下,进行适度创新,充分发挥司法建设在保障民生、实现社会正义、维护社会和谐的巨大功用,为构建具有中国特色的社会主义司法制度尽绵薄之力。
[Abstract]:After the liberation of Harbin by the Democratic Coalition Forces in April 1946, Harbin became the first big city in the country to be liberated. Since then, the democratic regime in the liberated areas of Harbin has completely abolished the "consular jurisdiction" and established the judicial sovereignty of the people as masters of their own affairs.In the course of judicial practice, the judicial system, litigation and trial, prison administration and mediation system with the characteristics of "city" have been gradually formed.The judicial construction in the liberated areas of Harbin is the beginning of the practice of the judicial construction of the city by the Communist Party of China. It has made outstanding contributions to the maintenance of public order, the consolidation of democratic power, the guarantee of economic development, and the support of the war of liberation.It is an important link in the course of judicial construction in New China.However, due to the constraints of the war environment and the lack of experience of democratic regime in the management of big cities, there are many lessons in the process of judicial construction.By studying the experience and lessons of judicial construction in the liberated areas of Harbin, we can learn from history, eliminate the old and the bad, take fewer detours in the current process of judicial reform, and make moderate innovations on the premise of maintaining Chinese characteristics.Giving full play to the great function of judicial construction in safeguarding people's livelihood, realizing social justice and maintaining social harmony, we should do our utmost to build a socialist judicial system with Chinese characteristics.
